Texas starts from the standard possession schedule, but a judge can order a different one after finding the default isn't in the child's best interest and doesn't work. School calendars and activity commitments are part of what gets weighed.

The money terms age the same way. If private school enters the picture, a court can order one parent to cover tuition on top of child support when it serves the child's best interest and that parent can pay. Enforceable later means the order names an amount, a due date, and a deadline for proof. Consent thresholds for optional activities are negotiated numbers, and the one that fit rec-league fees rarely survives a travel team.

Texas does start from a presumption that both parents share managing conservatorship, and it can be overcome with evidence of family violence or unfitness. But what that presumption settles is who makes decisions about school and medical care. The overnight schedule is a separate ruling.

The court's starting point there is the Standard Possession Order, which the law treats as a reasonable minimum, not the most a parent can receive. A judge can go above it. If a judge departs from it, a party can require the reasons in writing.

Parents lose ground assuming the calendar comes with the title. In practice, attorneys pull together 90 days of school records and extracurricular receipts before a temporary orders hearing. That record is what argues for time beyond the baseline.

Private school tuition isn't covered by base child support in Texas, it's a separate category courts can divide between parents under the family code. The Sworn Inventory and Appraisement is the document where both spouses list every asset and debt under oath, with each item classified as separate or community property. That's when the full picture stops being a guess.

The account has your name on it. Always has. You opened it before the wedding, deposited your paycheck into it every two weeks for years, and never thought twice about it.

Texas law doesn't care whose name is on the account. Under the community property presumption, every asset either spouse possesses at divorce is presumed shared, unless you can prove otherwise with clear and convincing evidence. That's a higher bar than most people expect.

What typically does the work is a paper trail: the statement dated before the wedding that establishes the starting balance, and documentation tracing every deposit forward from there. When community income mixed in over the years, that trace can get complicated fast.
