Effective October 7, 2026, the correct USCIS mailing address depends on your eligibility category and state. USCIS is allowing a grace period for packages postmarked on or before November 9, 2026, if sent to a previous location. After that date, applications sent to an incorrect address may be rejected. Online filing is not affected by this mailing address update.

Before mailing:

Your U visa approval may not be the end of the story. Sometimes, a ground of inadmissibility was inadvertently left off the original waiver. When you later apply for a green card based on your U visa, an additional waiver, nunc pro tunc, may need to be filed with your adjustment packet. “Nunc pro tunc” means retroactively—as if the waiver had been filed back then. A missed ground could put your application at risk, so have an attorney review your file before filing, not after.

Bring your original waiver filing and approval notice, and tell your attorney about any prior immigration or criminal history, even if it was long ago. Whether an additional waiver is needed depends on your case. Save this post.

Before filing:

Your USCIS case may be easier to track when your records are organized. A few simple habits could help you spot updates and respond on time:

✓ Check your status with your receipt number in USCIS’s online Case Status tool.
✓ Sign up for case alerts and updates.
✓ Keep every receipt and approval notice, plus a copy of everything you mailed.
✓ Respond promptly to any Request for Evidence (RFE) or other notice.
✓ Update your address with USCIS if you move.
✓ If your case is beyond normal processing times—or you receive a notice you don’t understand—consider contacting an immigration attorney. Next steps depend on your case.

Your immigrant visa interview is over, but the consulate says a waiver may be needed.

Often, this means a ground of inadmissibility was identified. The waiver depends on that ground: Form I-601 waives certain grounds; Form I-212 seeks permission to reapply after prior removal or deportation. One or both may be required.

Before proceeding, work with an attorney:
✓ Confirm the cited ground.
✓ Keep the interview notice and consulate request.
✓ Gather court, criminal, and immigration records.
✓ Prepare evidence and any required hardship explanation.

EAD renewal update: Starting Oct. 14, 2026, automatic extensions end for most EAD renewals. The former extension of up to 540 days is gone, so a gap in work authorization may occur while a renewal is pending. Rules depend on your case. Many asylum, parole, DACA, dependent-category and TPS renewals filed on/after Oct. 30, 2025 may be affected.

✅ Check your EAD category and expiration date.
✅ File as early as allowed—often up to 180 days before expiration.
✅ Keep proof of work authorization.
✅ Share your receipt with your employer and discuss timing; it may not extend authorization.
✅ Ask an immigration attorney about your case. Save this checklist.

Could your child already be a U.S. citizen? Under the Child Citizenship Act, citizenship may be automatic—no naturalization application, exam, or fee—if ALL generally apply at once before age 18:
✓ Born outside the U.S.
✓ Has a U.S.-citizen parent by birth or naturalization.
✓ Under 18.
✓ A lawful permanent resident (LPR).
✓ Lives in the U.S. in that parent’s legal and physical custody.

Different rules may apply if the child turned 18 before Feb. 27, 2001. Adopted children have separate requirements. A Certificate of Citizenship may be requested as proof.

Naturalization may be closer than you think. You may generally file Form N-400 up to 90 days before completing the required continuous-residence period.

Two tracks: 3 years as an LPR if married to and living with a U.S. citizen, or 5 years as an LPR.

Physical presence, continuous residence, good moral character, and English and civics testing still apply. Long trips abroad may affect eligibility.

Before filing: Check “Resident Since” on your green card; list every trip and its length. On the 3-year track, gather tax returns and proof of a shared life with your spouse. Ask an attorney to confirm your earliest filing date; filing too early may lead to denial.
