D.H. was in a motor vehicle accident and was injured. Receiving charges of DUI in the mail, Attorney Benyo contacted Attorney Benyo for help. After reviewing all of the investigative documents and reports from law enforcement, Attorney Benyo recommended Trial.

At Trial, the government argued that the charge of DUI was proven beyond reasonable doubt. Attorney Benyo countered that simply being in a motor vehicle accident was not proof of impairment and there was no evidence of drugs or alcohol obtained by the police. A.M. walked into a building owned by the Housing Authority with the express intent to go directly to the building office to request permission to collect belongings that were stored in her girlfriend's apartment. The Housing Authority Building Manager saw her and had a meltdown as she ordered A.M. to leave immediately and then called the police.

The answer is you most likely get charged with DUI.

HAVING A MEDICAL MA*****NA CARD DOES NOT PERMIT YOU TO DRIVE "UNDER THE INFLUENCE" .... and in PA "under the influence means any detectible amount of ma*****na or its metabolites in your blood.

BE AWARE WHEN ANSWERING QUESTIONS POSED BY LAW ENFORCEMENT. Ma*****na DUI laws in PA are not fair or logical. A bored Housing Authority employee viewed A.L. on video walking with her girlfriend to her apartment and had the Police file Felony criminal charges. Facing jail time and a Felony conviction for de minimum conduct, A.L. retained Attorney Benyo and had the Felony charge reduced to the lowest misdemeanor and jail time eliminated.

March 2022. D.R. was a student at a local high school who was attacked by two other students - one of which had a taser - as she was leaving school for the day. This was the culmination of bullying against D.R. by the other two students both on and off campus. Attorney Benyo reviewed the facts with the District Attorney's Office and D.R. became a witness in prosecuting the other two students and the criminal charges filed against her dismissed.

Don't assume that the Police have all of the facts established before they file criminal charges. Protection From Abuse (PFA) actions are serious and require serious attention as, if granted, the Court has the power to incarcerate without there even being any witnesses to the alleged abuse, evidence of abuse or anything beyond an allegation by an unhappy or aggrieved partner. March 2022. When accused by her boyfriend's ex-girlfriend of "assaulting" her daughter, KR went to Attorney Benyo for help defending against charges of Simple Assault.

Attorney Benyo demonstrated he was willing to litigate the criminal case to Trial and prepared to establish the "assault" was nothing more than another woman's fear of being replaced as a mother and a female child exaggerating a disciplinary event to gain attention. The case was dismissed prior to Trial.

Fear of disciplining a child is a fact in today's society - and children are taught how to use the criminal and cCYS system to their advantage. Parenting is not simple, and children need to be disciplined if they are to learn how to respect each other and adults.

L.L. was arrested for DUI in 2017, Convicted at Trial, Attorney Benyo filed the appeal to the Superior Court which reversed the conviction and sent it back to the Beaver County Court of Common Pleas. Having correctly argued that any evidence of ma*****na usage was inadmissible, the case was finally dismissed this month. No conviction. No penalties.

Facing 15 criminal charges (including DUI offenses and a Possession of Firearm) and an initial Plea Bargain Offer of State Incarceration, Attorney Benyo litigated the case and had 11 of the 15 charges withdrawn. J.C. successfully avoided DUI-Drug related charges with the help of Attorney Benyo. The District Attorney's Office dismissed the DUI charges after Attorney Benyo pointed out the traffic stop made by law enforcement was questionable as viewed on the Dash Cam video secured from the arresting officer. J.C. went from possible jail time and 1+ year of license suspension for DUI to no DUI penalty.
