The Daws Law Firm Secures $1.8 Million Settlement in High-Speed 18-Wheeler Rear-End Collision
The Daws Law Firm is pleased to announce a $1.8 million settlement on behalf of clients who suffered serious injuries after being rear-ended at a high rate of speed by an 18-wheeler. This case took a lot of digging to get down to the truth, but fortunately we have plenty of shovels. An investigation by our team uncovered an in-cab video of the driver looking down at his phone 15 times in the 38 seconds directly before impact. This was in violation of federal law and company policy prohibiting commercial drivers from texting and driving. During his deposition, the driver denied being on the phone because it was out of view until we pointed out that it could be clearly seen in his hand as he scrambled to break right before impact. When asked what he was looking down at in the video if not his phone, he said "my gauges." Our team then scheduled an inspection of his truck, and to nobody's surprise there were no gauges in that area where he was looking.
To make matters worse, his company tried to cover-up the accident. Instead of terminating their reckless driver, company documents showed that the driver randomly resigned in the days after the accident. Our team revealed what the company tried to cover-up. We showed that upon watching the video and seeing their driver on his phone, the company told him that he could either be fired or resign. After his resignation, the company then white-washed the paperwork to cover-up their driver's wrongdoing by putting that he "resigned for a better job opportunity", a completely made-up story. During the driver's deposition, the driver set the record straight, testifying that he actually wanted to stay with the company and in fact had no job prospects.
The insurance company initially undervalued the claim, extending a lowball offer of just $117,000. However, through relentless accident reconstruction, thorough investigation, and the aggressive pursuit of truth, our legal team exposed the truck driver's reckless conduct and the company's attempted cover-up. Faced with the truth, the insurance company ultimately agreed to a $1.8 million resolution - more than 15 times their original offer.
