💜 VAWA: YOU MAY HAVE AN IMMIGRATION OPTION WITHOUT YOUR ABUSER’S HELP
One of the biggest misconceptions about VAWA is that you must have been physically abused or have a police report.
That is NOT true.
VAWA allows certain survivors of abuse to apply for immigration benefits on their own — without the abusive family member filing for them or participating in the case.
👤 WHO MAY QUALIFY?
You may be eligible if you were abused by your:
💍 U.S. citizen or green card holder spouse or former spouse
👨👩👧 U.S. citizen or green card holder parent
👵 U.S. citizen son or daughter who is at least 21 years old
For spouses, you generally must also show that the marriage was entered into in good faith, not just for immigration purposes.
🚩 WHAT COUNTS AS ABUSE?
VAWA is NOT only about hitting, punching, or physical injuries.
“Battery or extreme cruelty” can potentially include:
• Physical violence
• Threats and intimidation
• Sexual abuse
• Severe emotional or psychological abuse
• Controlling behavior
• Isolation from friends or family
• Using immigration status as a weapon
• Threatening deportation
• Taking or withholding important documents
• Financial control or other coercive behavior
Every case is different, and not every unhealthy or unhappy relationship meets the legal standard.
📂 WHAT EVIDENCE CAN YOU USE?
USCIS allows any credible evidence. That can include:
📱 Text messages, emails or social media messages
📸 Photos or screenshots
👮 Police reports or protective orders
🏥 Medical records
🧠 Counseling or psychological records
👥 Statements from friends, relatives or others who witnessed what happened
📝 Your own detailed declaration describing the relationship and abuse
🏠 Documents showing you lived together
💳 Joint accounts, leases, insurance, taxes or other evidence of a shared life
💒 Wedding and relationship photos
📄 Proof of the abuser’s U.S. citizenship or permanent residence
📋 Evidence relating to good moral character
No police report? That does NOT automatically disqualify you. USCIS specifically permits VAWA applicants to prove their cases through other credible evidence.
🔐 AND AN IMPORTANT PART: CONFIDENTIALITY
A VAWA self-petition is designed so that the survivor does not have to depend on the abusive family member to pursue immigration relief.
You do not need your abuser’s permission to explore whether you qualify.

💜 VAWA: PODRÍAS TENER UNA OPCIÓN MIGRATORIA SIN LA AYUDA DE TU AGRESOR
Hay un mito muy común sobre VAWA: que necesitas haber sufrido violencia física o tener un reporte de la policía.
¡Eso NO es cierto!
VAWA permite que ciertas personas que han sufrido abuso soliciten beneficios migratorios por su propia cuenta, sin que el familiar abusivo tenga que presentar la petición, dar permiso o participar en el caso.
👤 ¿QUIÉN PUEDE CALIFICAR?
Podrías ser elegible si sufriste abuso por parte de tu:
💍 Esposo/a o exesposo/a ciudadano estadounidense o residente permanente
👨👩👧 Padre o madre ciudadano estadounidense o residente permanente
👵 Hijo o hija ciudadano estadounidense de 21 años o más
En casos de matrimonio, generalmente también debes demostrar que el matrimonio fue de buena fe y no solamente para obtener beneficios migratorios.
🚩 ¿QUÉ SE CONSIDERA ABUSO?
VAWA NO se limita a golpes o lesiones físicas.
Dependiendo de las circunstancias, el abuso o la “crueldad extrema” puede incluir:
• Violencia física
• Amenazas e intimidación
• Abuso sexual
• Abuso emocional o psicológico grave
• Comportamiento controlador
• Aislarte de familiares o amigos
• Utilizar tu estatus migratorio para controlarte
• Amenazarte con deportación
• Quitarte o esconderte documentos importantes
• Control financiero u otras formas de coerción
Cada caso es diferente. No toda relación tóxica, difícil o infeliz necesariamente cumple con los requisitos legales de VAWA.
📂 ¿QUÉ EVIDENCIA PUEDES PRESENTAR?
USCIS permite presentar cualquier evidencia creíble, incluyendo:
📱 Mensajes de texto, correos electrónicos o mensajes en redes sociales
📸 Fotografías y capturas de pantalla
👮 Reportes policiales u órdenes de protección
🏥 Expedientes médicos
🧠 Registros de terapia o evaluaciones psicológicas
👥 Declaraciones de familiares, amigos u otras personas que conozcan lo sucedido
📝 Tu propia declaración detallada explicando la relación y el abuso
🏠 Evidencia de que vivieron juntos
💳 Cuentas bancarias, contratos de renta, seguros, impuestos u otros documentos de una vida compartida
💒 Fotos de la boda y de la relación
📄 Evidencia de la ciudadanía o residencia permanente del agresor
📋 Evidencia relacionada con tu buen carácter moral
¿No tienes un reporte policial? Eso NO significa automáticamente que no puedas calificar.
Un caso VAWA puede demostrarse con diferentes tipos de evidencia.
🔐 Y ALGO MUY IMPORTANTE: CONFIDENCIALIDAD
VAWA está diseñado para permitir que una persona pueda buscar protección migratoria sin depender del familiar abusivo.
No necesitas el permiso de tu agresor para averiguar si calificas.
