Received an adverse court order? The clock is already running.
A disappointing judgment does not have to be the final word. But, in Florida what you do in the next 15 days can determine what you challenge later.
REHEARING: 15 days. A motion for rehearing must be served within 15 days of the date the judgment is filed. That motion must raise the issues for challenge or the right to appeal may be lost.
Why file, even if you expect a denial? Sometimes the court denies rehearing quickly. Other times, the judge pauses, takes a second look, and corrects the judgment, saving time and the cost of an appeal. If your motion is denied, you have preserved the issues for appellate review.
APPELLATE REVIEW. Review must be filed in 30 days of the final judgment. If you served a timely motion for rehearing, the 30 days generally runs from the written order on rehearing.
Computation of deadlines are strict and missing them can permanently cost the chance to fix an error.
