What The Clerks Wish You Knew

The court clerks are an integral part of our justice system and have a wealth of knowledge about the inner workings of the court system. This program will provide a chance to hear directly from clerks working in the state, federal, and bankruptcy courts. Hear the dos and don’ts of working with clerk’s office, learn their tips for best practices when interacting with the court system, and better understand the role of the clerks in the changing world of e-filing. There will also be an opportunity for questions and answers with the panelists.

Picking the Jury: Tools & Traps

Jury selection is a critical part of the jury trial process. The makeup of the jury can dramatically affect a party’s chances of a favorable verdict. Juror questions, challenges for cause, and preemptory challenges all present prime opportunities for lawyer advocacy before the trial begins in earnest. This program will discuss the mechanics of jury selection, as well as effective strategies and potential pitfalls in both civil and criminal jury trials.

One hour of general CLE credit will be awarded for this program. This event has also been pre-approved for annual rostering credit with the Maine Commission on Indigent Legal Services.

The Rule of Law as a Sustaining Force in Rural Communities

According to a June 2014 report on bar demographics, outside of Cumberland County, just 10% of lawyers in private practice in Maine are under the age of 35, while approximately 65% are 50 or older. In the coming years, rural counties will likely face a shortage of lawyers as aging lawyers retire, which will lead to access to justice challenges. In response to this anticipated shortage, Maine Law recently received funding from the Maine Justice Foundation for a three-year pilot project that will place law students with practitioners in communities that would otherwise have limited access to legal services.

Protecting Your Client: How Lump Sum Settlements Affect Public Benefits

Without careful planning by the attorney, a lump sum settlement or inheritance can adversely affect a client’s eligibility for public benefits. This program will provide an introduction to various public benefits programs such as Supplemental Security Income (SSI), SNAP (food stamps), MaineCare, public housing, and Temporary Assistance for Needy Families (TANF). Presenters will explain the options available to your client to protect a lump sum settlement, including first-party special needs trusts, spend down, and the new ABLE Act accounts.

Demystifying Bankruptcy

Bankruptcy is a unique part of federal law. There are specialized courts, a separate set of procedural rules, and plenty of long and complicated forms. This program will provide insight on navigating the bankruptcy process for the practitioner who does not regularly handle bankruptcy cases. Specific topics to be addressed include the intersection of bankruptcy and family law, the consensual modification of residential mortgage loans in chapter 13 cases, and exceptions to the automatic stay.
