Many Maryland drivers use the terms DUI and DWI interchangeably, but under state law, they are two separate offenses with different thresholds and penalties.

DUI, or driving under the influence, is the more serious charge and generally applies when a driver's blood alcohol concentration is 0.08 percent or higher, or when the driver is substantially impaired.

DWI, or driving while impaired, applies at a lower threshold, generally 0.07 percent, and can also be based on evidence of some impairment even without a specific BAC reading. While penalties for DWI are less severe than DUI, both carry significant consequences that can affect a person's license, insurance, and career.
