⚠️ Your green card shouldn’t depend on someone else’s compliance record.

This month, the Department of Labor suspended several major employers, including Microsoft, from the PERM program. PERM is the labor certification most employers have to complete before they can sponsor a green card.

For many H-1B professionals, that means a sponsorship path they counted on may now be on hold.

🧭 There are paths that don’t depend on an employer:

🔹 EB-1A: extraordinary ability, self-petition
🔹 EB-2 NIW: National Interest Waiver, self-petition
🔹 O-1A: a nonimmigrant option that can offer more flexibility than H-1B

The right option depends on your profile, your field, and your timeline.

If you’re unsure where you stand, that’s usually the first step.

🏠 Remote work feels flexible. Your H-1B is not.

Many professionals assume that working from home doesn’t change anything. For immigration purposes, your home office is a worksite, and every worksite has to be covered.

📍 Same metro area as your LCA
An amended petition generally isn’t required, but the LCA notice has to be posted at the new location. That can be a physical posting for 10 business days or an electronic notice.

✈️ Different metro area
A new LCA and an amended H-1B petition generally have to be filed before you start working from the new location.

💰 Wage
Your salary has to meet the prevailing wage for the area where you actually work.

The risk usually isn’t remote work itself. It’s moving first and dealing with the paperwork later.

If you’re planning a move or a remote arrangement, it may be worth confirming where you stand first.

🚀 Your EB-1A case may already be built. You just haven’t organized it yet.

For engineers and tech professionals, one of the strongest paths to an extraordinary ability green card is a project-based approach.

📂 Catalog the projects you’ve led or contributed to
🧩 Categorize them against the EB-1A criteria
🎯 Develop them strategically into evidence of sustained impact

What it’s not: ignoring your career and rushing to publish an article in a little-known journal just to have “something” to file.

Your track record is the foundation. Strategy is what makes it visible.
If you’re exploring self-petitioning, it may be worth understanding how your past work could be positioned.

🛡️ You've been granted asylum. What comes next?

Asylum gives you protection, but it isn't permanent residence. Many asylees wait longer than they need to, or don't know when to start.

📌 The path forward:
1️⃣ Asylum is granted
2️⃣ One year of physical presence in the U.S. after the grant
3️⃣ Apply for adjustment of status (Form I-485)
4️⃣ Lawful permanent residence, which opens the path to citizenship

💡 Timing, travel history and documentation all matter at this stage, so preparing early helps.

If you're unsure where you stand, that's usually the first step. 📩 DM us or schedule a consultation.

⚠️ AI is moving fast. Some employers are moving faster, away from sponsoring foreign talent.
We’re already seeing PERM labor certifications stall at major tech and consulting companies. For many H-1B professionals, that puts the green card timeline in someone else’s hands.
💡 The real question isn’t “what happens if my employer stops?” It’s “what’s my strategy if they do?”
✅ EB-1A and NIW are self-petitioning green card options. No employer sponsorship. No PERM. Your profile carries the case.
If you’re unsure where you stand, that’s usually the first step. 📩 DM us or schedule a consultation.

Dear algorithm, please connect me with the tech professionals who want a green card without depending on their employer. 💻

Here's what many H-1B and L-1 professionals don't realize: you may be able to self-petition for permanent residency. No employer sponsor. No waiting on HR to sign. 🔑

📍 EB-1A: for individuals with extraordinary ability
📍 EB-2 NIW: for work that serves the U.S. national interest

You don't need a prestigious title or an academic background. What matters is the impact of your work, and how your case is positioned. 📋

If you work in tech, engineering, or any high-skill industry, it may be worth understanding your options.

🎃 Don’t let immigration uncertainty haunt you. 👻
AI tools can be helpful, but building an immigration petition involves more than filling in forms. Your evidence, eligibility, and case strategy all need careful attention—especially for employment-based options such as EB-1A and EB-2 NIW.
If you’re considering these pathways, book a consultation with Silmi Law to discuss your situation and possible next steps. 🕯️

🚨 Filed your adjustment of status? Your H-1B still matters.

Many professionals assume that once the I-485 is filed, their work visa no longer matters. Now more than ever, that's a risky assumption.

📌 While your adjustment of status is pending:
✅ Maintain your H-1B (or other employment-based status)
⛔ Don't start working on your I-485-based EAD

Why? Switching to the EAD can mean giving up your underlying status. If anything goes wrong with your green card case, you could be left with no status to fall back on.

💡 A pending application isn't the same as an approved one. Protect your position until the process is complete.

If you're unsure where you stand, that's usually the first step. 📩 DM us or schedule a consultation.

🎓 Think you need a PhD or academic publications to qualify for EB-1A? Not necessarily.

Many industry professionals rule themselves out because they believe EB-1A is only for researchers and academics. That's one of the most common misconceptions we see.

If you work in a high-skill field, you may be able to build your case on business contributions you've actually been responsible for:

💼 Projects or contributions that made a real impact on your industry and your organization
🧭 Leading or critical roles at the companies you've worked with
💰 A high salary compared to others in your field, which is one of the objective EB-1A criteria

The difference isn't always eligibility. It's how your case is positioned. ✨

If you're in industry and exploring the EB-1A, it may be worth understanding your options. 📩
💬 Comment "EB1A," and we'll send you more information on how industry professionals approach this pathway.
