Growing and re-branding. I've been transitioning from Realtor to Lawyer over the last five years. I started moving away from Real Estate sales and transitioned to Real Estate Law (and Probate Law) when I joined Coleman & Horowitt LLP. In May 2025, I switched my focus to starting my new firm: Eagle Heritage Law PC. I stepped away from Facebook, and now its time to update my profiles and business pages.

Prop. 33: I'm voting "no," and I ask you to do the same.

The text on the ballot fails to explain the meaning of the repeal. The code sections that are being removed are the ones that give homeowners the right to choose rental prices for their real estate. Without Civil Code section 1954.50 (and the following code sections). The state has the option of setting rental rates.

Specifically, the code states: "Notwithstanding any other provision of law, an owner of residential real property may establish the initial and all subsequent rental rates for a dwelling or a unit about which any of the following is true . . . ." (Civ. Code, § 1954.52.)

In the sections that follow, the code continues to elaborate exceptions, and the biggest exception is where a homeowner voluntarily trades their right to set prices in a deal with a Public Agency (think HUD units, aka Section 8.).

I accept that the State currently controls how I can change rent from month-to-month and year-to-year, but I don't want to give up my power to negotiate the starting price of a contract. That's why I am voting "no."

Prop 3. I'm voting "no," but not for the reason you think.

Perry v. Schwarzenegger (N.D.Cal. 2010) 704 F.Supp.2d 921 declared that section 7.5 is unconstitutional. Section 7.5 states that the word "marriage" in California shall only be recognized to mean the union between a man and a woman, but this section is legally invisible after Perry v. Schwarzenegger and has no meaning in our lives.

Prop. 3 appears to "fix" the problem, by taking out the bad words (which have no meaning or effect any more) and replacing them with words that look friendly. However, the new words have no impact and don't add any new protections. It is changing a document for the sake of changing the document, without consideration to the long-term effects.

Personally, I prefer to leave the gap in our Constitution where Section 7.5 has no impact, and the federal constitution governs our rights within California.

Vote your conscience, but you must know that regardless of whether you vote "yes" or "no" on Prop 3, the words that currently appear in that section have zero effect on your lives because they are unconstitutional as compared against your federal constitutional rights.

I’m a California attorney that helps people set up estate plans (like trusts) and businesses (like LLCs). The other day, I decided to test out some new AI software for making explainer videos. To my surprise, the content filter flagged a completely safe and harmless script! Naturally, this led to some frustration. What does a frustrated lawyer do? Push limits, of course—within the boundaries of the system!

So, I decided to test it further by creating a joke video that was exactly the opposite: not safe at all, completely about a prohibited topic—but still crafted in a way that stayed within the rules of the system.

The result? The system consented to my new video's creation! Given their strict content filter, this impliedly stamps the video with the software creators approval that the video complies with its terms of service.

The process helped me make a final decision about whether I’ll be using this software going forward.
