Stevie Jo is a partner at McDonald C***s Law Group, where she specializes in estate planning, trust administration, guardianships, conservatorships, and pre- & post-nuptial agreements. She is dedicated to helping families navigate important legal matters with care, clarity, and expertise.

A double BA graduate in History and Philosophy from UC Santa Cruz, Stevie earned her JD from Roger Williams University School of Law, where she co-founded the Family Law Society. She was admitted to practice law in California in June 2014 and brings extensive experience in estate planning, probate, and family law matters.

Outside the office, Stevie Jo enjoys spending time with her husband Mike and their two boys, Nathan and Maverick. She’s a huge San Francisco Giants fan with a goal to see the Giants play at all 30 MLB stadiums... she’s already checked 17 off the list! ⚾ When she’s not cheering on the Giants, she loves outdoor adventures, sports, and making memories with family and friends.

😂!!!! But on a serious note, I get calls daily from realtors regarding properties in my active probate cases. And my clients get scam mail weekly! Probate makes everything a public recored. All your debts, accounts, properties, down to what is in your house is listed out for anyone to see.

Probate: post pandemic, the probate courts are still severely backlogged. On Friday I filed a standard probate petition, to be given a hearing date in 7 months!!!!

Probate is not a fun process. The disadvantages of probating a will are many. The probate process is expensive, time consuming, and intrusive. Court costs, attorney fees, personal representative fees, bonds, and accounting fees all add up.

Probate exists to assist the loved ones of those that did not have the ability for one reason or another to do their estate planning beforehand. And in the state of CA all stand alone wills must go through probate.

People tell me all the time “I don’t need a Trust because I don’t have an estate.”

Let’s unpack this for a moment. Everyone has an estate. And estate is simply what you own, Regardless of if you own one house or 20.

In the state of California, if your estate values at more than $180k (meaning the money in the bank, the gross value of your home, your cars, any stocks, bond or retirement accounts..etc) then your estate will enter probate when you pass away.

A Trust is the only tool that can prevent your loved ones from dealing with probate. Even your spouse (we will discuss that in another post).

So bottom line: everyone has an estate and if you own more than $180k in assets, you should have a trust.
