SB 6, the current version of the bail reform bill, passed the legislature and is headed to the Governor's desk. TCDLA opposed SB 6 for a number of reasons, but specifically because it disallows personal bonds for a broad list of offenses, and it substitutes the judgment of the legislature for that of the local magistrate in regard to setting bail. We anticipate court challenges will be forthcoming relative to SB 6.

SJR 3, the constitutional amendment to allow for the denial of bail, did not pass. During the regular session, this constitutional amendment did receive enough votes to pass, but this time around it fell short of the required votes. This measure will not be on the ballot in November. However, with this being a former emergency and special session item, it is always possible we could see this again.

Travis County’s adult jail system has held roughly 1,600 inmates on any given day since the coronavirus crisis hit Central Texas two months ago.

Yet, remarkably, none of them have tested positive for COVID-19, an extraordinary feat considering the many outbreaks popping up at detention facilities elsewhere in the state.

As of Tuesday, 208 inmates in Bexar County had tested positive for the virus and had yet to recover. Tarrant County, home of Fort Worth, had 58. Fannin County, northeast of Dallas and with a small rural population, had two.

The state capital? Zilch.

This was amazing work by my friends Doug O'Connell and Ken Ervin. The body worn camera footage and in-car video, only snippets of which were released publicly, made the situation look like improper officer conduct, and the Travis County District Attorney's Office and the Austin Police Department moved quickly for indictments and trial against these two officers. At trial, when more of the video and other relevant evidence was presented to a jury, the officers were found Not Guilty. Despite this, however, they did not get their jobs back at Austin Police Department. Doug and Ken kept the battle going, and this is the result of their dedication and hard work.

Huge Legal Victory today. Proud to represent the brave men and women of law enforcement.

Now, under reworked federal rules, students accused of sexual assault will have added protections, including the presumption of innocence, the right to be provided all evidence collected against them, and the right to cross-examine their accusers during live hearings, although it must be done through a lawyer or representative.

Ronnie Earle was an honorable man and I'll miss him. He was a gentleman; he never failed to treat every person he talked to with dignity, compassion and respect.

I have a fond memory of my first meeting with him. It was during my interview with him in July 2004 to become an Assistant District Attorney serving Travis County under his administration, and we talked about all the standard interview/job application questions, e.g. where'd you go to law school, where else have you worked, what are your goals. But, that took us about 5 minutes and then he asked me "Have you read any good books lately?" I told him I was now; that I was (re) reading the book "The Endurance, Shackleton's Legendary Antarctic Expedition" by an amazing woman, Caroline Alexander. Mr. Earle and I spent the better part of the next hour talking about adventure and perseverance as though we'd been friends for years, and, maybe, had shared some of those fanciful adventures together.
