📣 Attention Employers: Important Update on the New Federal Overtime Deduction (2025–2028)

The IRS has released guidance to help employees claim the new overtime pay deduction and employers play a big role in making sure workers get the benefit.

Here’s what you should be doing:

✅ Keep Accurate Payroll & Time Records
Track all hours, regular rate, and overtime separately. Save pay stubs, timecards, and payroll reports.

✅ Give Employees Clear Overtime Info
Because separate reporting on the W-2 won't start until 2026, for te upcoming 2025 tax reporting it helps to note the total overtime paid. Periodic overtime summaries are even better.

✅ Document How You Calculate Overtime
If you pay more than time-and-a-half (like double time), make sure the formula is documented and easy to explain.

✅ Retain All Supporting Records
Keep payroll registers, timekeeping logs, OT approval forms, and policies. Employees may need these to claim their deduction.

✅ Confirm Employee FLSA Status
Be ready to tell employees whether they’re non-exempt and eligible for FLSA overtime. Only those employees whose overtime compensation is required to be paid (i.e., non‐exempt employees) are eligible for the qualified overtime compensation tax deduction under IRC §225.

✅ Prepare for 2026 Reporting Changes
In 2026, W-2s/1099s will require separate reporting of qualified overtime. Start looking into your payroll systems now and how to make the change come Jan 1st.

✅ Train Payroll & HR Staff
Make sure your team understands what counts as qualified overtime and how to document it properly.

📌 Bottom Line:
Good records + clear communication = helping your employees get the tax break they’re entitled to and keeping your business compliant.

If you need help updating your payroll processes or employee communication, we're here to assist.
