This memo is not the law. And it was never meant to be.

According to Jennifer Walker Gates, Board Certified Immigration Attorney, the new USCIS adjustment of status memo is designed to intimidate the immigrant community into not applying for benefits they are legally entitled to. It is a way to suppress legal immigration, and it has no legal authority above what Congress has written into law.

Congress created the legal immigration system. A policy memo cannot override it.

Si ICE te presenta un documento, tienes derecho a saber exactamente qué estás firmando y qué consecuencias tendrá. Si ya firmaste algo sin entenderlo, es posible que puedas deshacerlo, pero el tiempo corre.

The new USCIS memo on adjustment of status has caused a lot of concern — and understandably so. But before you panic, here's what the memo does NOT cover.

The memo does not appear to apply to people seeking adjustment of status through the U visa program, VAWA, asylum, TPS Advance Parole, DACA Advance Parole, or military Parole in Place. If your case falls under any of these categories, you should continue your process with confidence, and as always, with the support of a qualified attorney.

It also does not mention waivers, which remain available to many applicants who are overstays or have past misrepresentations on their record.

And critically: the memo has no effective date. It simply states that "additional guidance may be issued" in the future.

The law has not changed. But now more than ever, having an attorney build the strongest possible case for you — and prepare a backup strategy if needed — makes all the difference.
