This program provides a detailed examination of abusive trust arrangements, including so-called “non-grantor, complex, irrevocable, discretionary, spendthrift” trusts and ecclesiastical trust schemes, and explains why these structures fail under federal income tax law. Attendees will learn how IRC sections 641 and 643 operate, why fiduciary accounting income does not control taxable income, and how the IRS and courts apply economic substance and assignment-of-income doctrines to invalidate these arrangements. The session also offers practical guidance for advising clients who have been drawn into these schemes and for navigating related ethical considerations.
