In Texas, filing first usually doesn't make a huge difference. But there are two consequences to filing first to know:

1. If your case goes all the way to trial, the petitioner (the person who filed first) typically presents their case first.
2. The petitioner is often responsible for having the Final Decree of Divorce drafted, which can mean additional attorney's fees.

The decision to file first should be based on your specific circumstances—not fear that you're somehow gaining or losing a major advantage.

Let's talk about the Equal Protection Clause.
Just because you're the mom doesn't mean you automatically get primary custody.
And just because you're the dad doesn't mean you're at a disadvantage.
Courts are not supposed to favor one parent over the other based on gender. The focus is on what's in the best interest of the child.
A lot of parents walk into divorce assuming custody is already decided. It's not.
The facts matter. Your involvement matters. Your parenting matters.
