Para calificar para una visa E-2, debes demostrar que tienes un negocio real y activo, pero eso no significa que tu negocio tenga que estar abierto.
Definitivamente querrás demostrar que tienes una identificación fiscal federal para tu negocio y una cuenta bancaria comercial. Puedes demostrar que tu negocio es real y activo comprobando que compraste inventario, firmaste un contrato de arrendamiento en una oficina y/o negoció o que firmaste contratos con clientes, proveedores u otros proveedores de servicios. Esas son una gran evidencia de que tu empresa es real y activa y de que estás trabajando para ponerla en funcionamiento.

La visa E-2 es para ciudadanos extranjeros para que vengan, vivan y trabajen en sus negocios en los EE. UU.
Si tu país tiene un tratado que respalda las visas E-2 con los Estados Unidos, puedes solicitar esta visa incluso si tu negocio aún no está abierto, pero debes mostrar evidencia clara de que tu empresa es real
y activa (no solo dinero en una cuenta bancaria) y con esto demostrar que estás trabajando para abrir tu negocio al público.

The E-1 is a product of treaties.
So to be eligible for an E-1 import/export treaty, your home country has to have a treaty with the United States
that supports these kinds of visas.
Many countries do, including Mexico, Spain, and Canada. If you are from a country that has one of those treaties
then you might be eligible for an E-1 visa if your business does a high volume of
international trade between the United States and your home country.
