ARRESTED. NOW WHAT?

The handcuffs go on. You’re taken to jail. What happens next? And how long can they hold you before you see a judge?

This week on The Right to Know, we’re breaking down what happens after an arrest in Georgia.

First: Booking. You’re processed into the jail, which typically includes fingerprints, a photograph, and identification.

Next: Bond. Some offenses have a preset bond that allows you to secure release without first appearing before a judge. Other offenses require a judge to consider bond.

Then: First Appearance. If you remain in custody, you generally must appear before a judicial officer within 48 hours of an arrest without a warrant or 72 hours of an arrest with a warrant.

Here’s what you need to understand: Your first appearance is NOT your trial. The judge explains the charges, advises you of your rights, and addresses bond when authorized.

An arrest is not a conviction. Knowing what happens next matters.

I’ve seen an uptick in DUI arrests lately, and I’m noticing some recurring trends.

A DUI investigation does not always begin as a “DUI stop.” It may start with something as simple as speeding, failure to maintain lane, an improper turn, a tag violation, or another traffic offense. Once the vehicle is stopped, an odor of alcohol or ma*****na, an open container, admissions about drinking or smoking, or other observations can quickly turn a routine traffic stop into a DUI investigation.

A few important numbers to know in Georgia:

👉🏼 .08 BAC — drivers age 21 and older
👉🏼 .04 BAC — drivers operating a commercial motor vehicle
👉🏼 .02 BAC — drivers under age 21

And remember: being below .08 does not automatically mean you cannot be charged with DUI. Georgia also recognizes DUI “less safe,” meaning the investigation may focus on whether alcohol or drugs allegedly impaired your ability to drive safely.

Thank you to Lucy C. Laney High School for inviting me to preside over your mock trial in recognition of 2026 Law Day. The students were absolutely fantastic — thoughtful, prepared, professional, and deeply engaged throughout the proceedings.

This year’s Law Day theme, “The Rule of Law and the American Dream,” reminds us that the law exists to protect opportunity, fairness, and justice for all. It was inspiring to see the next generation of leaders, advocates, and changemakers embracing those principles in such a meaningful way.
