AI companies are entering a new era of legal scrutiny. As lawsuits mount over alleged real-world harms tied to generative AI, courts are being asked a fundamental question: Are AI platforms neutral tools or active participants responsible for the content they generate?

From wrongful death claims against OpenAI following the Florida State University shooting to lawsuits involving chatbot interactions linked to self-harm and psychological manipulation, plaintiffs are testing the limits of Section 230 immunity and reshaping the legal theories surrounding AI liability.

With courts, regulators and lawmakers all weighing in, the AI litigation landscape is evolving rapidly — and this may be only the beginning.

The legal industry is watching closely as the D.C. Circuit prepares to hear arguments over Trump-era executive orders targeting major law firms and their clients.

At stake is whether executive power can be used to penalize firms based on the clients they represent, the causes they support or the viewpoints they advocate.

Four firms — Wilmer Cutler Pickering Hale and Dorr, Jenner & Block, Perkins Coie and Susman Godfrey — successfully challenged the orders in federal court, winning permanent injunctions after judges found serious constitutional concerns. Now, the appeals process could shape the future boundaries of executive authority, attorney independence and First Amendment protections.

Read more about the case that could become one of the defining legal battles over executive power and constitutional protections in recent years.

The U.S. Supreme Court may be on the verge of redefining how digital evidence is gathered with implications for privacy, criminal investigations and corporate data practices.

In Chatrie v. United States, the Court is weighing whether “geofence” warrants — which allow law enforcement to collect location data from every cellphone in a specific area and timeframe — violate the Fourth Amendment.

At stake is a fundamental question: Can your phone become a witness against you before investigators even know who they’re looking for?

The case highlights growing tensions between:
- Digital privacy rights
- Law enforcement investigative tools
- Tech companies’ data retention practices
- Constitutional protections in the age of location tracking

A ruling is expected by June 30, and it could reshape the future of digital evidence for years to come.

Bellwether trials in the Uber sexual assault litigation are delivering mixed, but increasingly consequential results.

From a defense win in California to plaintiff victories in Arizona and North Carolina, evolving legal theories like “common carrier” status and “apparent agency” are gaining traction.

With ~3,400 federal cases and hundreds in California alone, these early outcomes may significantly influence settlement strategy and future gig economy liability standards.

A Supreme Court decision on tariffs is triggering a massive legal ripple effect, and billions of dollars are on the line.

After ruling that the use of emergency powers to impose sweeping global tariffs was unlawful, the Court left one major question unanswered: who gets the money back, and how? Now, an estimated $166 billion in potential refunds has set off a wave of litigation involving thousands of businesses, federal agencies and plaintiffs’ attorneys.

Companies across industries, from major global brands to small businesses, are navigating a complex and uncertain path forward. Some are turning to the courts, while others are waiting on a newly proposed federal claims portal that may take time to deliver results. Meanwhile, a second front is emerging: consumer lawsuits.

The U.S. Supreme Court’s upcoming decision on birthright citizenship could have sweeping implications for immigration law and for thousands of families across the country.

During April 1 oral arguments, justices examined President Trump’s 2025 executive order seeking to limit citizenship for children born in the U.S. based on their parents’ immigration status.

Potential outcomes and impacts:
- Uphold current interpretations of the 14th Amendment, preserving birthright citizenship and maintaining the existing legal framework.
- Strike down the order on narrower statutory grounds under the Immigration and Nationality Act, leaving room for future legislative or legal challenges.
- Uphold the executive order (viewed by many observers as least likely), creating new documentation requirements.

The executive order remains blocked while the Court deliberates, with a decision expected by the end of June.

Immigration lawyers and their clients are closely watching the case and its potential impact.

Is Big Tech approaching its “Big To***co moment”?

A recent jury verdict against Meta and YouTube could signal a fundamental shift in how courts view social media platforms.

For decades, Section 230 has shielded tech companies from liability for user-generated content. But in a landmark case, plaintiffs took a different route: they framed social media harm not as a content issue, but as a product liability problem.

The argument? Platforms were deliberately engineered to be addictive through features like infinite scroll, algorithmic amplification and social validation loops.

With thousands of similar cases already pending, plaintiffs may now have a clearer roadmap to try to circumvent Section 230.

A major shift in real estate compliance is unfolding.

A federal court in Texas has struck down FinCEN’s nationwide anti-money laundering rule for residential real estate transactions, just weeks after it took effect. The rule aimed to increase transparency in all-cash property deals by requiring detailed reporting on buyers, sellers and sources of funds.

The court, however, found that FinCEN exceeded its authority, halting the rule nationwide and suspending reporting obligations for now.

What this means:
- Reporting requirements are currently suspended, easing compliance burdens for real estate professionals
- The broader fight over transparency vs. regulatory overreach is far from settled
- A growing split among federal courts makes an appeal likely

Bottom line: This is a pause, not an endpoint. Stakeholders should stay alert as the legal battle and policy direction evolves.
