A power of attorney gives someone the authority to act on your behalf during your lifetime, but what happens to that authority after you pass away?

A power of attorney generally ends at death. At that point, the person named as your agent no longer has authority to manage your affairs under that document. Responsibility for handling your assets may instead fall to a successor trustee, executor, or another person with the appropriate legal authority.

Understanding where one role ends and another begins is an important part of creating an estate plan that works when your family needs it most.

Choosing a successor trustee is about more than naming someone you trust. The person you select may eventually be responsible for managing assets, following the terms of your trust, communicating with beneficiaries, handling financial matters, and making important decisions during what can already be a difficult time for your family.

A successor trustee can play an important role in how smoothly your estate plan works when the time comes.

Estate planning is about more than deciding who receives your assets. It’s also about having a plan in place for the moments when you may not be able to make important decisions for yourself.

The right documents can provide guidance for managing your finances, identify who you trust to act on your behalf, and give your loved ones greater clarity during difficult or unexpected circumstances.

A thoughtful estate plan helps put your wishes in writing before they’re needed!

An estate plan isn’t something you create once and forget about! As life changes, your plan may need to change with it.

Marriage, divorce, the birth of a child or grandchild, changes in your finances, buying or selling property, or the loss of a loved one can all affect whether your existing plan still reflects your wishes.
Reviewing your estate plan periodically can help make sure the decisions you made years ago are still the decisions you would make today.

Don’t let an outdated plan speak for you when it matters most!

What happens to the property taxes on a California vacation home when it passes to the next generation?

Proposition 19 changed the rules for transferring real estate between parents and children, and vacation homes can be especially impacted. A transfer may trigger reassessment to current market value, potentially resulting in a significant increase in annual property taxes.

Join Jim Cunningham for our free webinar, "Vacation Homes and Prop 19: Property Taxes", where he’ll discuss how Prop 19 can affect vacation homes, what families should know about property tax reassessment, and important planning considerations when hoping to keep a property in the family.

Does getting remarried mean you should update your estate plan?

The answer is yes!
Remarriage is a major life change that can affect your assets, beneficiaries, and the people you want to protect. This is especially important for blended families or when children from a previous relationship are involved.

Reviewing and updating your estate plan after remarriage can help make sure your documents reflect your current family, circumstances, and wishes!
