The other driver had insurance. It just was not close to enough.

This is one of the most common situations we hear about, and one of the least understood.

Georgia requires drivers to carry liability coverage, and the required minimums are modest. An ambulance ride, an emergency room visit, and imaging can run through them before treatment really begins. Then the letter arrives saying the policy is exhausted, and people assume that is the end of the road.

It is not necessarily. Underinsured motorist coverage on your own policy is built for that exact gap, and Georgia law requires insurers to offer it.

Whether it applies to you, and how it works alongside the other driver's policy, depends on your specific policy language. Which is a real answer, not a dodge. Policies differ.

The rideshare company's insurance offered you a check. Before you sign anything, two questions.

First: which coverage period actually applies to your crash? Georgia sets very different minimums depending on whether the driver had accepted a ride or was just logged on waiting. That single fact can change what is available by a large margin.

Second: are you done treating? An early offer usually shows up before anyone knows the final medical picture. Not because anyone is being sneaky, but because settling early is genuinely better for the insurer.

Accepting generally closes the claim permanently. If something turns up in six weeks, that door is shut.

None of that means an early offer is always wrong. It means you should know what you are trading before you trade it.

You were walking. A car hit you. You do not own that car, and maybe you do not own any car.

Does your own auto insurance still do anything for you?

Often, yes. And almost nobody thinks to ask.

Uninsured and underinsured motorist coverage on a personal auto policy can follow the person, not only the vehicle. That means it may apply when you are hit as a pedestrian, not just when you are behind the wheel.

Which matters enormously if the driver who hit you had no coverage, or had the state minimum and your hospital bill passed it on day one.

Depending on the household, a family member's policy may come into the picture too.

Before you accept anything from anyone, it is worth finding out what coverage you actually have access to.

The driver who hit you has no insurance. That is not the end of it.

Uninsured motorist coverage exists for exactly this, and it sits on your own auto policy, not theirs.

Georgia law requires insurers to offer it. Plenty of people carry it and have no idea, because they picked their policy years ago and have not looked since.

There is a related version, underinsured motorist coverage, for when the other driver has some insurance but nowhere near enough. That situation is far more common than having none at all.

Here is the free step anyone can take today: pull out your declarations page and read what you actually bought. Not the app summary. The declarations page.

A lot of people find out they were better protected than they thought.

An Uber driver hit your car. You were never a passenger. Whose insurance is on the hook?

In Georgia it comes down to the driver's app status at the moment of the crash, and there are three very different answers.

App off, driving for themselves: it is an ordinary personal auto claim against their own policy.

App on, logged in, waiting for a ride request: rideshare coverage applies, but at a much lower required minimum.

Ride accepted or passenger on board: Georgia requires at least one million dollars in coverage for that period.

Same collision, wildly different outcomes, and nobody standing at the scene can tell which it was by looking.

If a rideshare vehicle was involved in your crash, that detail is worth nailing down before anyone starts talking numbers.

The driver told police you stepped out in front of them. Here is what Georgia law actually asks of drivers at a crosswalk.

Under Georgia law, a driver has to stop and remain stopped for a pedestrian crossing in a crosswalk when that person is on the driver's half of the road, or approaching and within one lane of it.

That is a real obligation, and it is more demanding than most drivers assume.

There is a limit. A pedestrian cannot suddenly leave a curb and walk into the path of a car that is too close to stop safely.

So two different rules can be in play, and which one fits depends on details: where you were in the crosswalk, how far away the car was, what the driver could see.

Those facts do not sort themselves out. And the driver's version arrives first.
