Ethylene Oxide (“EtO”) is a chemical used for, among other things, the sterilization of medical equipment. The compound is widely recognized as a human carcinogen and named in hundreds of lawsuits in Georgia as the cause of cancer and other medical conditions.

Recently the White House temporarily exempted certain corporations, including commercial sterilization facilities, from the Clean Air Act standards requiring emission controls. This means that these facilities can continue emitting EtO without using the protections called for by the Clean Air Act for two more years.

We believe these new compliance standards will put the health of more Americans at risk. Penn Law Attorney John Hadden explains why Ethylene Oxide is so dangerous to humans.

Penn Law is proud to have represented the plaintiffs in a significant premises liability case involving a Golden Corral franchise in Newnan, Georgia. Attorneys Darren Penn, John Hadden, and Kevin Ketner advocated for the family of Teddy Connell, who tragically passed away after a fall caused by hazardous chair design and placement in the restaurant.

After the Eleventh Circuit revived the case, a settlement was reached on the first day of trial—bringing long-awaited closure for the Connell family.

A new study reported in today’s AJC shows fewer than 1% of injury lawsuits filed in Georgia result in awards of $10 million or more. Attorney Darren Penn tells the AJC that most large verdicts are never paid and are often the beginning of serious settlement negotiations. A former DeKalb County State Court judge also told the AJC that in his more than ten years on the Court, he didn’t preside over a single verdict over $10 million. The facts beg the question, why does Georgia need tort reform and who will really benefit? We believe big business and insurance companies will be the largest beneficiaries of tort reform and the real victims will be those who are harmed by the negligence of others.
