Something worth sharing from a CLE I attended last week with some of the top personal injury attorneys in Georgia.
Most people think distracted driving means texting. But under Georgia law, it means any action that takes your focus away from safely operating your vehicle. That includes hands-free phone calls, eating, and adjusting your dashboard. Insurance adjusters know this definition and they use it. So do I.
On every car accident case I take, I request the other driver's black box data immediately, before it can be overwritten or the vehicle is totaled. In a recent case, that data showed the at-fault driver slowed to 1.2 mph at a stop sign but never came to a complete stop, then accelerated to 8 mph at 25% throttle just before hitting my client. That data conclusively establishes negligence.
I also go through your medical records with you before the insurance company does, and I look beyond the two drivers to identify every liable party, including any employer like Uber or DoorDash whose driver was on the clock.
