In August 2017, plaintiff Lisa Ruede slipped and fell on wet stairs at the diner, incurring serious injuries to her head, shoulder and elbow. Recently, a judge declared a mistrial in one of our medical malpractice cases on the basis that there was a jury question whether the defense law firm and their client doctor engaged in fraud. So, what happens after a mistrial? Once it’s declared, the jury is discharged, and, depending on the reason for the mistrial, the Court either will direct that the trial begin again with a new jury or dismiss the charges.
