What happens during the presentation of evidence? ⚖️

After opening statements, the parties begin presenting evidence to support their positions in the case.

Evidence may include witness testimony, documents, photographs, records, exhibits, and other information admitted by the court.

Attorneys question witnesses and may challenge evidence presented by the opposing side. The judge determines what evidence may be admitted, and the jury considers the admitted evidence when deciding the case.

An opening statement is each side’s first opportunity to explain the case to the jury at the beginning of a trial.

Attorneys may outline the facts they expect the evidence to show, introduce important issues in the case, and help the jury understand what they will hear from witnesses.

An opening statement is not evidence. It is an introduction to the case and a preview of what each side expects the evidence to establish.

After opening statements, the parties begin presenting evidence and calling witnesses.

What is jury selection? ⚖️

Before a trial begins, the jury must be selected.

Potential jurors may be questioned about their backgrounds, experiences, and whether anything could affect their ability to be fair and impartial.

Attorneys for each side may also have opportunities to ask that certain potential jurors be excused from serving.

Once the jury is selected, the trial can move forward with opening statements and the presentation of evidence.

What is a pretrial conference? ⚖️

Before a case reaches trial, there are often important issues that need to be addressed.

A pretrial conference gives the court and the parties an opportunity to discuss matters such as scheduling, witnesses, evidence, motions, and other issues that may affect how the case moves forward.

It can also help narrow the issues that remain in dispute and clarify what each side expects to present if the case proceeds to trial.

Understanding each stage of litigation can make the legal process a little less confusing.

What happens if mediation doesn’t resolve a case? ⚖️

An unsuccessful mediation doesn’t necessarily mean the litigation process stops. The parties may continue gathering evidence, filing motions, preparing witnesses, and addressing other issues as the case moves forward.

Settlement discussions can also continue after mediation. If the parties ultimately do not reach an agreement, the case may proceed to trial, where a judge or jury may decide the disputed issues.

Understanding what comes next is part of understanding the litigation process.

What is mediation, and what role does it play in a legal case? ⚖️

Mediation is a process where the parties meet with a neutral third person—a mediator—to try to resolve some or all of the issues in a case.

The mediator doesn’t decide the case or force either side to reach an agreement. Instead, mediation gives the parties an opportunity to communicate, evaluate their positions, and explore possible solutions.

If an agreement is reached, the case may be resolved without going to trial.

Understanding each stage of the legal process can make an unfamiliar system a little easier to navigate.
