SB 68 sailed through Judiciary Committee based on partisan politics alone. Despite compelling testimony regarding the clear deficiencies in the “tort reform” bill, no material and helpful amendments were made to the legislation.

What does this mean? It means the time is now for Georgians to call their State Senator and tell them this bill is not what you want for yourself, your family, or your neighbors. It only helps insurance companies and erodes your 7th Amendment right to a civil trial to hold wrongdoers accountable for negligence, greed, and profiteering at your expense.

I'm on my semi decade looking through my childhood baseball card collection. Although I'm only about 10% through and have many more valuable rare cards (Jordan who?) These are my favorite so fall I pulled and put in a case. You can tell I'm bias to my childhood hero!!!

SB 415 is working its way through the Georgia Senate right now. Why should you care? Because if it's passed, it guts your rights. It helps insurance companies at your cost. This bill harms victims of crime, honest victims of accidents, victims of human trafficking, victims of cancer exposure, and victims of corporate cover-ups. Our friends, our family, our neighbors, human beings.

Instead of protecting Georgia citizens, it would protect:

corporations and large businesses (and their insurance companies) from responsibility for ignoring suspicious or dangerous conduct, even though ignoring that conduct caused serious harm or death (including hotels who ignore signs of human trafficking on their property) (Section 7-2);

insurance companies and truck companies by not allowing them to be sued directly when the truck they own or insure hurts or kills people (Section 4-2) and negligent truck drivers by presuming they are qualified to drive their vehicle (Section 4-3) even though they hurt or kill people;

insurance companies and manufacturers from their responsibility to make sure their products are safe and helping them avoid the consequences when they chose to instead market and profit from cancer-causing products (Section 7B-2, Section 7B-3);

insurance companies and auto manufacturers from having a duty to warn even after they have learned that their car is unsafe and killing or seriously injuring people (Section 7-1). In these cases, this bill would seriously limit what paralyzed individuals and grieving families could recover (Section 7A-2). It would change the law to protect a company that knew something was wrong with their product and chose to hide it from their customers to save money instead of fixing the problem.

It limits what injured individuals can introduce in court to show that they are injured, while in the same section expanding what insurance companies and their lawyers can introduce to attack those people (Section 7A-1). It also creates new ways for insurance companies to attack treating doctors' testimony when they say their patient suffered an injury (Section 6-1).

It claims to reduce the "cost of doing business" but it will not. It does not reduce insurance premiums. It does not incentivize business (reality check: Georgia has been voted THE top place to do business for SIX years running). If anything, it 𝒊𝒏𝒄𝒓𝒆𝒂𝒔𝒆𝒔 the cost of doing business, and hands that big fat check to 𝙪𝙨.

It is a bill for insurance companies, not for us. Please call your state senator and ask them to vote NO on SB 415 today. If you live in Georgia, you should care because this directly affects you.

‘I feel compelled to let everyone I care about know about Georgia Senate Bill 415. 2 things: (1) This bill is awful; and (2) The shady way it has been pushed through should be made public.
Simply put, this will limit you and your loved ones' constitutional right to a trial by jury under the 7th Amendment and will hurt the elderly and veterans.
This bill is being pushed through backroom deals by Big Insurance and corporate lobbyists and career politicians. Two of the senators pushing this bill are lawyers who get paid to represent insurance companies. This bill makes more than a dozen radical changes to existing Georgia law, rigging the system and reversing your constitutional rights.
If passed, Senate Bill 415 would limit your Constitutional rights to hold accountable in a civil court of law those who might harm your loved ones – like drunk or negligent drivers. The bill would shield big government politicians and bureaucrats from being held responsible for their actions if they harm Georgia taxpayers. Senate Bill 415 would even protect wrongdoers like corporations who knowingly introduce poisonous products to our children and families. One provision of Senate Bill 415 would shield hotel owners from liability for s*x trafficking even if they know or should know it is happening on their property.
Big Insurance and corporate lobbyists are in the shady corners of our State Capitol trying to push this bill through as fast as possible with no input from the public. What do I mean by that? This bill changes municipal law, rules of evidence, product liability, punitive damages, rules of discovery, and a host of other areas of law. Normally, the bill would go through the Senate Judiciary committee. However, those pushing this bill have taken the unusual step to put it in the Senate Insurance committee (no lawyers) where there is literally ZERO vetting or opposition.
Please contact your State Senator and tell them to vote NO to this awful Senate Bill 415.’

Bring it on AllState. An affirmative defense to allegations you suck and dont protect your insured is the truth. And it is the truth. If you have been, or are currently being, screwed over by AllState, call me. It needs to STOP!
