Our Litigation & Coverage Group recently enjoyed a lunch outing with our Summer Law Clerks, providing another opportunity to connect, share experiences, and strengthen relationships outside the office.

Attorney Marilyn Kapaun says that it’s days like today that it feels good to be a Family Lawyer! See proud father, AJ Petrangeli, who is showing off his Order of Legitimation at the Fulton County Superior Court with his family law attorney, Marilyn Kapaun. He is now not only the biological father of his son, but the LEGAL FATHER. It is with pride that we do the work that we do. Congratulations, AJ! BKBM was happy to be a part of it.

We love our clients, and our clients love us!

I switched to Marilyn after 3.5 years with a previous attorney to handle my divorce. My only regret is not switching to Marilyn sooner. Marilyn truly cared about the outcome my case. She was very responsive to any questions or concerns I had. She is very knowledgeable with what to expect and always one step ahead of opposing counsel. BOVIS, KYLE, BURCH, AND MEDLIN WIN IN THE 11TH CIRCUIT ON A 1ST AMENDMENT CASE FOR ALPHARETTA, GEORGIA
Mike Stacy was the lead attorney defending the City of Alpharetta in an action brought by the Sons of Confederacy. The Sons wanted to march in the City sponsored Old Soldier’s Parade waiving the Confederate battle flag. The City barred the flag from the parade, and the Sons sued. Mike Stacy argued that when the City sponsored a parade it was the City communicating a message that was “government speech” and the City had the right to control precisely how it spoke. The District Court denied the Sons an injunction against the City and the Parade went on without the battle flag. And the Court granted the City Summary Judgement against all of the Sons’ constitutional claims under 42 U.S.C. 1983. Leake v. Drinkard, 2020 WL 6166588 (N.D. Ga. 2021).
The Sons appealed and the 11th Circuit affirmed, holding that the City’s actions were not a constitutional violation of the Sons’ rights and upheld summary judgment in favor of the City.
The Circuit Court held that when a government speaks it can convey the message it wants, and that the City was allowed to set the rules for those participating in the parade. The opinion, authored by Chief Judge William Pryor, recognized that when the government speaks it is not barred by the Free Speech Clause of the First Amendment from determining what content it communicates and not allowing messages of others it rejects.
