What happens to a business during a divorce in Georgia?

The answer depends on the type of business and the circumstances surrounding it. In some cases, the business itself may not be divided directly, but that does not necessarily mean the other spouse walks away with nothing.

There may be other ways to account for the value or equity built during the marriage, including alimony or a lump sum payment.

Every situation is different, especially when a business is involved.

If you are going through a divorce and have questions about business ownership or division, TDE Family Law can help you understand your options.

What is the difference between legal custody and physical custody?

Legal custody refers to who has the authority to make important decisions for the child, including decisions about education, medical care, and extracurricular activities.

Physical custody refers to where the child lives and who has the child in their care at a given time.

Understanding the difference matters because each type of custody affects your rights and responsibilities as a parent.

If you have questions about custody in Georgia, TDE Family Law can help you understand what applies to your situation.

Who gets the house during a divorce in Georgia? It depends on the circumstances.

The court may consider when the home was purchased, how it was used during the marriage, what changes or investments were made to the property, and how closely the home is tied to each person’s life or business.

Owning the house before the marriage can be an important factor, but every case is different.

If your home is one of the biggest questions in your divorce, TDE Family Law can help you understand your options.

How long does a divorce take in Georgia? It depends.

An uncontested divorce can sometimes be finalized relatively quickly when both parties agree on all the terms. A contested divorce, however, can take much longer depending on issues like evidence, discovery, property, custody, and how willing both sides are to reach a resolution.

Sometimes the biggest factor is not the complexity of the case. It is the level of conflict between the parties.

If you are considering divorce in Georgia, TDE Family Law can help you understand what to expect and guide you through the process.

Can a child custody order be changed in Georgia? Yes, absolutely.

A custody modification may be possible when circumstances have significantly changed and modifying the existing order would be in the child’s best interests.

Simply wanting more time with your child may not be enough. The court will look closely at what has changed and why a new custody arrangement may be necessary.

If your family’s circumstances have changed and you are considering a custody modification, contact TDE Family Law to discuss your options.

Before filing for divorce, know what matters most in your case.

If children are involved, understanding the factors a judge considers when determining custody is essential. If significant assets are involved, remember that Georgia follows equitable distribution — meaning property is divided based on what the court considers fair, not automatically 50/50.

Every divorce is different. The key is identifying the potential issues in your case, being clear about what you want, and understanding that the final outcome may require compromise.

Knowing what to expect before you file can help you make more informed decisions from the start.

Moving away can change more than your address. It can change your custody arrangement too.

If one parent relocates out of state or even several hours away, the current parenting plan may no longer be realistic.

A move from Atlanta to Savannah, for example, could make a week on, week off schedule difficult to maintain and may be considered a substantial change that supports modifying custody sooner.

When distance changes the logistics, the parenting plan may need to change with it.

A prenup or postnup doesn’t have to mean you’re planning for the relationship to end.
Sometimes, it simply means having an important conversation about expectations, finances, and the future.

If it’s something you’ve been thinking about, avoiding the topic can create frustration or resentment. Whether you bring it up over dinner, in counseling, or during a private conversation, communication is key.

Have the conversation before the silence becomes the problem.
