Tort reform is a key issue in this year’s legislative session. One part of the proposal would prevent victims from arguing-or even mentioning-the full value of their damages that were caused by companies or institutions. The right to a trial by jury is a Constitutional right guaranteed by the Seventh Amendment. Tort reform starts a dangerous path that limits our rights as Americans - a right that goes back to the founding of our nation.

A promise of tort reform is that it will attract more business to Georgia and reduce the cost of living and working in this state. The reality is tort reform will not lower insurance rates or the power of big business. If anything, it will give more power to big business and insurance companies by failing to hold them accountable. Governor Kemp’s claims that Georgia needs tort reform is based on the false claim that litigation is driving insurance increases. The reality is the numbers do not show a litigation crisis but instead show rising insurance rates and an increase in the number of claims denied each year, even as insurers report record profits. Insurance reform would make Georgia a better state to do business.

Yesterday, the Georgia Supreme Court ruled in favor of our client, reversing the Court of Appeals and trial court and permitting her claims against the Clayton County Sheriff (arising out of an auto accident we alleged resulted from a deputy's negligence) to proceed.

[B]ringing claims against the appropriate government officials in their official capacities was a recognized way to proceed against a governmental entity—be it the State or one of its counties, read the high court opinion.

Last Tuesday, John Hadden argued before the Georgia Supreme Court on behalf of a client injured in an auto collision caused by a sheriff’s deputy. The case is a significant one involving interpretation of the county presentment statute, which requires notice of claims to counties within one year of the injury. Specifically, the Court is expected to rule on whether notice is required in cases involving sheriff's departments, and if so, to whom the notice has to be provided. The Court of Appeals has issued several opinions on the subject over the past 13 years, but the Supreme Court has not yet addressed the issue.
