The cat is out of the bag! My firm is going to be merging with Shafritz and Dean starting Friday. This is a step towards actually being able to retire. I have promised to work with them for at least 5 years to help integrate my clients. After that we can talk buy out.
Its pretty emotional to be shutting John Maurer Law down after 21 years. My firm is old enough to drink! But this is the right move for my future, and I thank Doug for the opportunity.

Man. So depressing:

Woman emigrates to America from a war torn country. She meets man and starts a life with him. They get a "lease to own" contract on a house and start paying it off.

Man does something very bad. Ends up thrown in jail and has a $640,000 restitution lien field against him.

One year later, they finish the lease to own contract.
For reasons that defy logic, the Attorney puts the property in the name of Woman AND MAN, which causes the $640k lien to attach against the house.

Woman, having divorced man and wanting to start her own life, tries to sell property, only to find there is a $640k lien against it.

This woman was in tears when I explained to her what happened. Worse, if the attorney who did the closing for the lease purchase had just ONLY put the property in her name, everything would be fine.

I went into real estate law because it is the only field of law where generally everyone is happy at the end. This one did not have a happy ending

Make sure, when you are closing deals, to check the name of the buyer for liens as well. They will attach to the property and make it difficult for them to refinance or sell.

So every year I have to do 12 hours of CLE. Since I have been doing it every year for 30 years I don't honestly learn a lot.

I usually try to learn 2 things. Today I learned one:

A SCRIVENER’S ERROR WILL NOT DEFEAT THE CLEAR INTENTION OF THE PARTIES, WHICH MAY BE EVIDENCED BY THE ENTIRETY OF THE CONTRACT. -Humble v. Opendoor Prop. J, LLC, 373 Ga. App. 210, 908 S.E.2d 57 (2024).

I have always believed this. Its nice to actually have been ruled on.

So I really tried to get into the office today. I learned to drive on snow by parents who were born and raised in Iowa and so whenever it snowed Dad would take me out to learn to drive in it.

My hope was "no one else is going to be going out in this. I should have the road to myself." This was about 90% true. The other 10% was cars sprawled all over the road not sure what to do.

Eventually I called it quits and worked my way home, detouring several times around stopped cars completely blocking the road.

In the "WTF" Category. Someone got ahold of a check I wrote to pay Gwinnett County Taxes on a closing and washed the remitter and changed it to "Brandon Perry." $12,000 tax check.

I have stopped payment on "Brandon Perry" check and remitted a new check (With a $120 late fee out of my pocket) to Gwinnett.

Why do people think they will get away with this stuff?

I don't post here near as often as I probably should. But August is a celebration of the 20th year John Maurer Law has been in business. I opened my doors August 2004. At the time I had 2 employees. One of whom is with me to this day. The firm grew rapidly and in just one year I had a second attorney as well as 5 other employees.

The crash in 2008 almost toppled me. I ended up losing all but 2 employees and had to shelter with another Law Firm to help me get my feet back under me. I was able to do so and in 2012-2013 I actually made more money than any time in firm history.

Since then I've had 2 different offices. One on Powers Ferry and currently on Roswell Road. I expect to be around another decade or so. I look forward to celebrating my 30th anniversary with friends, family and clients.

So I just had someone call and ask about a cash closing. I explained that the closing was cash. She repeated like 5 times "A cash closing, right?" Eventually I realized that she meant she wanted a stack of bills, not a wire transfer. I tried to explain to her that there was no reasonable way for me to get a QUARTER MILLION DOLLARS in cash and that the largest stack of cash I ever saw at one time was about $20,000. She said she would ask around and see if some other attorney could accommodate her.

I get the oddest phone calls:

Caller: Can you resend the closing docs in Word Format?

Me: I don't generally do that. Why?

Caller: If its in .pdf I can't make changes to them.

Me: Thats deliberate. I don't want you to make changes to the closing docs.

So Fed Ex contacted me to say their rep for me had changed. They asked if my contact was still Faye White. Ms. White was an excellent employee but has not worked for me for 15 years.

I wonder now how many emails dropped into the void?

So I just got news that one of my closest clients and an all around good friend, Jeff Landers passed. I met Jeff around 2009 through my contacts at Fearnley Califf. He bought and sold real estate and managed to amass a good amount of money doing it. He was a solid man who always did what he believed to be the right thing.

I know he was married and it didn't go well. So when he met the second love of his life, Antonella, he refused to marry her, preferring to call her his "lover." She was with him when he had trouble breathing and called 911, but it was too late.

Jeff wasn't just a client. He was a great friend. If I were to post that I was feeling down on Facebook, I could expect a call from him within hours. He had my back not only professionally but personally in a way that few others have.

His heart was bad and he had other bad genetics. His brother passed at 49 about 5 years ago. He leaves no children, but he was great with other people's children.
His passing has left a huge hole in the world. He was one of the good ones
