Legal Tidbit #8: Tenants, you can't just stop paying rent because the landlord hasn't fixed something. There is a process you must follow in order to establish your rights. So, if you show up in court saying that you didn't pay your rent because something hasn't been repaired, unless the residence is uninhabitable, you will usually lose...quickly.

Legal Tidbit #7: As an attorney it oftentimes frustrates me when someone is frightened by a legal situation, does something that they probably shouldn't have done in response, then calls me. It is best to call an attorney as soon as the issue arises. You will likely make things worse if you act without legal advice. So, before you panic and make a move, get legal advice first. Legal Tidbit #6: If you can no longer pay your court ordered child support due to a loss of employment, in order to avoid penalties that includes possible jail time, the first thing you should do is petition the court to modify your payments. To just not pay is asking for trouble. You are bound by the court order whether you have a job or not. Only the court can excuse you from making the ordered payments. In short, if you don't want to go to jail for child support, tell the court that you can no longer make the payments and why, don't just tell your ex.

Legal Tidbit #5: A federal court recently held that an unpaid internship needs to be more that menial work such as making coffee, making copies, filing, answering phones, etc. Instead, the intern should be participating in more substantive work and learning the particular business. So, if you have an unpaid intern in your business, don't just relegate he or she to an administrative assistant, or they may be able to file suit against you.

Legal Tidbit #4: Unlike many other states, the Georgia code does not authorize retroactive/back child support. So, the noncustodial parent does not necessarily have to pay since birth, they may only need to pay from the date the claim is filed. Again, this Georgia rule is different from many other states.

Legal Tidbit #3: In Georgia at least, if your car is damaged or stolen in valet parking, there is a legal presumption that the valet company is at fault. However, if the valet can show that they performed with proper diligence (didn't mess up), then you may have to rely on your insurance instead of theirs.

Legal Tidbit #2: If you have two loans on your home, and your home is worth less than your first loan, you can get rid of the second loan in bankruptcy, so that will be about 30K or so that you won't owe anymore.
