If something happened to you today… would your family actually be able to step in and help? Not emotionally, legally.

Most people assume their spouse or loved ones can automatically make decisions for them. But without the right documents in place, they may be forced to go to court just to:
✔️ Access your accounts
✔️ Pay your bills
✔️ Make medical decisions

That delay can create stress, conflict, and unnecessary expenses—at the worst possible time.

The truth is, this is completely preventable with a simple pre-crisis estate plan. This isn’t about planning for death.
It’s about protecting your life, your voice, and your family if the unexpected happens.

Don’t wait for a crisis to find out your family is stuck.

Beneficiary designations override your will. Clean them up and make sure you have the right people as your designated beneficiaries. Here are a few things you can do:
• Check life insurance and retirement accounts
•Avoid naming your estate as beneficiary
•Consider naming your trust when needed
• Add contingent beneficiaries
• Always check your beneficiary designations after major life events such as marriage, divorce, or new partners
Smart planning ensures your assets are distributed to your designated beneficiaries in days, not months and without conflict or confusion.

Business Owners!

What happens to your ownership of your business if something happens to you?
Whether you operate as an LLC, corporation, or partnership, your governing documents (operating agreement, bylaws, or partnership agreement) control what happens at death. If those documents aren’t aligned with your estate plan, your family and business partners could face disputes, delays in decision-making and unnecessary legal fees and court involvement. So it is critical that your business documents and estate plan work together as one cohesive strategy. Smart planning ensures your business continues smoothly, your family is protected, and your legacy stays intact, without conflict or confusion.

Probate may be especially challenging for business owners and parents of minor children.
If you are a business owner or a parent of minor children, estate planning isn’t just something to think about later—it’s something that protects the people and the work you care about most. Without a plan, your family may have to go through probate court before they can access assets, manage your business, or even make important decisions. Probate can take months, sometimes longer, and during that time your loved ones may face unnecessary stress, delays, and expenses. For parents, the stakes are even higher. If something unexpected happens, a court could be left to decide who manages assets for your children and how those resources are used. For business owners, your company could face uncertainty about who has authority to operate accounts, make decisions, or keep the business running smoothly.
A properly designed estate plan including a revocable living trust can help your family avoid probate, maintain privacy, and ensure that the right people can step in and manage things without court delays.

After a loved one passes, everything turns on one question: Did they leave a valid Will?
Your answer determines which petition must be filed with the probate court—and filing the wrong one can cost months of delay and additional legal costs.

Common starting points include:
• Petition to Probate Will in Solemn Form
• Petition for Year’s Support
• Petition for Letters of Administration (when there is no Will)

Each option has different notice rules, timelines, and who has priority to serve. I’ve seen families lose momentum—and money—simply because they didn’t understand this first step.

Let us help you navigate or avoid the process. Our experienced team of professionals will help you understand your options. Please go to our websites to schedule a consult today.

What is probate and why you should avoid it…

Probate is the court process used to settle a loved one’s affairs—pay debts, transfer property, and make assets legally pass to heirs. Many families are surprised to learn that even with a Will, probate is often still required in Georgia. This month I’m breaking probate down in plain language so you know what to expect before a crisis happens. In my next videos, I’ll explain how probate actually gets started and the petitions families have to file in probate court. If you own a home, have minor children, or run a business, this is information you don’t want to miss.
In the interim, you can feel free to contact us and learn more about ways we can help you avoid probate.www.legacyplanningmatters.com www.legacyplanningfirm.com

Today, we reflect on a part of Dr. Martin Luther King Jr.’s legacy that often goes unspoken: intentional planning as an act of love and responsibility.

Dr. King understood that our lives and achievements should outlive us. Owning property, building businesses, raising children, and caring for elders are powerful achievements. Protecting those achievements is just as powerful. Estate planning is not about wealth alone. It’s about:

Preserving family stories and values
Protecting children and loved ones
Preventing unnecessary conflict and court involvement
Creating order where there could otherwise be chaos

While planning may be quiet but it is a powerful form of empowerment. It says: my family matters, my work matters, and my legacy deserves care.

Today, we honor Dr. King by continuing work that helps families plan with clarity, dignity, and purpose, so what they build can truly serve generations to come.

Happy Birthday, Dr. King!
