Given that we settled our case in Barrow County before trial, we mediated four cases in the last couple weeks. Thanks to the exceptional efforts of mediators Doug Wilde, Wayne Wilson, Gino Brogdon Jr., and Tom Harper, we resolved all four cases for amounts fair to our clients. The Atlanta legal community, including our adversaries, is a talented and reasonable group of professionals. I t allowed us to resolve cases without the risk of trial. Merry Christmas!

For the first time since February 2020, we were in court this morning prepared for a jury trial in Barrow County. We had an outstanding client who was seriously injured in a car wreck on Interstate 85. She was great to work with. As usual Steve Thornton provided helpful counsel and Becky Britt Busch had all the bases covered during my manic preparation. Special and important assist to Craig Avery, who, on Friday afternoon, took my unsolicited call and gave me the lay of the land in a part of Georgia he has dominated for years (He also went above and beyond the call of duty to call two other lawyers in that area to get their perspective). Without his insight and efforts, I don't know whether we would have settled the case "on the courthouse steps". I'm glad for my tremendous client that we could resolve this. Just three mediations to go before Christmas. Happy Holidays!

Belated 11th birthday "props" to our firm on November 8! In Becky Britt Busch and Amy Stewart Williamson, I couldn't have two better people to help me practice law! It's a little surprising that, given my twenty-four years of working on cases and Jeffrey Brand's twenty-four years of handling insurance claims for insurance companies, we haven't worked together before. But, thankfully, that happened this week. Thanks to his professional and smart handling of our case, we were able to resolve it efficiently and fairly. That's good for my client and me! Hoping to meet him some day for a beer Wild Leap Brew Co. Cheers!

A few months ago, Miles Mediation & Arbitration started a program called ADR on Demand. It is designed to facilitate a more efficient mediation process for cases where the case value is less than $100,000. Today, I used it for the first time, and it worked well to resolve our case for a deserving client. Even better, it introduced me to mediator Kristen Pitts, who did an excellent job. Hope to work with her again as well as opposing counsel Veronica L. Hoffler. Glad Miles introduced this program!

Thanks to a suggestion by Steve Thornton years ago, Randal George has been serving our lawsuits and doing an excellent job, especially when the "serve" is difficult. As he works all around town, he frequents thrift stores and recently found a Notre Dame poster (the one over his right shoulder) he thought I'd like. He bought it for me having no idea I actually attended that game as a student. Today, he decided it was time to hang the poster, the frame of which he tightened up. He also decided the other ND poster ("Snow Bowl" against Penn State) needed to be hung after being on the floor of my office the last four years. When I used the internet to refresh my memory, I was reminded that the two posters were from games a week apart my Senior year! Whoa! Anyway, George is a great guy/friend/process server who made my office look much better today. Thanks George! Go Irish!

Ten years ago, on November 8, 2010, we started our law firm. There are too many people to thank for helping us, but special thanks to Amy and Becky, who keep me sane (mostly) and focused. The Atlanta personal injury legal field is a great one to practice in, and colleagues on both sides of litigation have supported us. Also, special recognition to our clients, who give us a reason to work AND routinely refer us additional work. So, cheers to us and Notre Dame Football for a similar accomplishment last night! ;)

Thanks to Keegan Federal, a couple years ago, we were hired by a client, who was injured as a result of a chemical spill in a chicken processing plant in Southeast Georgia. When it came time to mediate the case, at the recommendation of multiple lawyers in Southeast Georgia, we used Miles Mediation's Savannah office neutral, Danny Cohen. Just like Miles Mediation's Atlanta office neutrals, Danny was awesome! Thanks to his smart and personable handling of the mediation, we achieved a great resolution for our deserving client! Opposing counsel included Charlie McDaniel, who trained me as a young defense lawyer. I have always admired and enjoyed Charlie, so it was good working with him. Now we won't need Allison Azar to serve as a trial consultant in Bulloch County. ;)

Today, we had our first virtual depositions through Zoom technology. Thanks to Elizabeth Gallo Court Reporting and their court reporter Natalie Sandi for making it seamless. The experience was as close as could be to "in person" depositions. Enjoyed working with opposing counsel Rudy Harris. Perhaps now Allstate will have enough information to work with us toward a fair resolution?!?! Stay safe! Stay well!

Yesterday, we completed our first mediation using Zoom. Mediator Doug Wilde reminded me of Ed Harris in Appollo 13 deftly navigating us through unchartered waters. While the stakes may have been a little higher for the Appollo crew, like them, we survived. Thanks to great effort by Doug, opposing counsel Matt McLaughlin, Chubb Insurance, and my client a very difficult case resolved. Approximately 13 years ago, I was fortunate to meet Doug as one of the first opposing lawyers I had as a plaintiff's lawyer. He was great to work with then, and he still is today as a mediator. And one of these days perhaps we'll race in some type of swim/bike/run effort. Today, a former client and a current client both checked in on us to make sure we're healthy. Last weekend, an opposing counsel, who has become a friend over the years (we'll call him "Don Madelman"), unsolicited (ie. I don't have a case with him right now), texted to check in on us. Gratifying to think we've made friends with the different participants in our business. Our particular practice area in Atlanta seems to lend itself to that even with our adversaries. Earlier today, Bryan Sutlive noted he thinks opposing counsel and adjusters are being friendlier these days. While the pandemic itself sucks, there's good coming out of it (including using technology like Zoom to attend depositions and mediations). Stay safe, stay healthy!

Here's a direct quote from an e mail from a client:

"Thank you for explaining the lawsuit process. 😂 I don't know what I thought you would say. I'm just having trouble wrapping my mind around the process. I always thought that people who filed insurance lawsuits were ambulance chasers. After my dealings with this insurance company my eyes have been opened."

Even as a young insurance defense lawyer, I thought the same way about plaintiffs and their lawyers. Then being on trial against Lance Cooper and Andrew Jones provided an epiphany that plaintiff's lawyers can be very professional and capable. Every day I am reminded of that in sharing office space with Steve Thornton (thanks to Kristin Erdman for making that connection)! This isn't to suggest insurance companies are bad, but, like all of us, they prefer to keep their money, and, thus, plaintiff's lawyers are needed to facilitate justice. I'm glad that over twenty years of practicing law allows me to participate in a process that can be intense and rewarding.

Happy Friday! Go find a fish fry tonight, or let me buy you a beer at Moondog Growlers! And go to bed early Saturday so you don't lose an hour of sleep; even a good plaintiff's lawyer can't get you justice against daylight savings! ;)
