What Is Probate — And Should You Be Worried? 🏛️📜

The word "probate" often makes people nervous. But understanding what it actually is can take away a lot of that fear.

Probate is the legal process through which a deceased person's estate is administered in accordance with the terms of the person’s will — debts are paid and assets are distributed — under the supervision of the Georgia Probate Court. If there is no will, then the court-supervised process is intestate administration, and property is distributed to heirs according to the rules under state law.

Here's what probate or estate administration involves:
• Filing the Will (or establishing there isn't one) with the court
• Appointing an Executor or Administrator to manage the estate
• Notifying creditors and settling valid debts
• Distributing remaining assets to heirs

Not all assets go through probate. Life insurance with named beneficiaries, joint accounts, and assets held in a trust typically pass outside of probate entirely.

Probate in Georgia can take several months to over a year depending on the complexity of the estate. Having an experienced attorney guide the process makes a real difference.
