Y’all, it is way too quiet in here. 🤫

I’ve reached a point of desperation. This morning, I spent twenty minutes trying to get the office wall to see things from the ceiling fan’s perspective.
The wall didn't budge, and the fan just kept going in circles. Neither one of 'em was interested in a compromise.

I’m used to a busy February, but a few folks had to reschedule, and now I’ve got three wide-open dates staring back at me. If I don't get some real folks in here to mediate soon, I’m liable to start trying to settle a boundary dispute between the stapler and the tape dispenser.

In am the "Voice of the Carrollton Trojans." It's a commitment during football season to show up every weekend to describe the on-field action. It requires detailed preparation of statistics, jersey numbers, and storylines. Do I have to spend hours prepping for every game? No. It is my choice. It is my security blanket to not sound like an idiot on air.

The mantra "Preparation is Key" is an overused one in the legal profession. However, it is 10,000% true. While for surgeons, perfection is key to a good outcome; lawyers only need to be prepared to put their best efforts forward. It is impossible to control all variables in a legal setting. I see so many lawyers collapse under their starve for perfection. It is unattainable.

Perfection is impossible for a play-by-play person too. Inevitably, you will refer to the "clock" as the "c**k." You will also mention the need for "dry balls" when the game is a rainy mess. There will be burps, sneezes, unpronounceable Eastern Bloc country names, and everything in between.

My hobby as the "Voice of the Carrollton Trojans" has helped me immensely with my perfectionism. Just being your raw self is what people want. Authenticity wins over perfectionism all day long!

West Georgia is home. Carrollton born and bred. Need proof? Listen to me talk. Our side of the state has produced some excellent mediators. Who doesn't remember the incomparable Tommy Greer? "True Calling" is one of those buzzwords you find in business books. Think yourself to success!! Follow this blueprint to success!! Blah, blah, blah. It's WAY easier to find things you enjoy. NIKE got it right all those years ago - "Just Do It" - I started my mediation practice happy to get one or two mediations per month. Well...2023 had other plans for my mediation practice. CADE'S MUSINGS ON MEDIATION

I am 44 years old. For almost all of those 44 years, I have been told that I talk too much. I have documents from school principals and teachers to prove my assertion.

During the course of a mediation, I make a lot of statements and ask a lot of questions. I tell the participants at the outset to not think that my big mouth is helping my brain to pick a side. That's not my job as a mediator. I am not Judge Judy. I am neutral and impartial.

Every single mediation my job is to take a realistic look at the positions of the parties. My questions and comments often serve as thinking points for the parties. I am more direct than many mediators but that is my nature.

Remember...the mediator’s comments can serve as an important reality check to the parties.

CADE'S MUSINGS ON MEDIATION - (WARNING - Soapbox Moment)

I get it. I have been there in my own law practice. There are times where going to mediation feels pointless. You've litigated the case for a couple of years. Settlement negotiations have been a dumpster fire. The judge orders you to mediate. You huff and puff about spending a day listening to me talk while stuffing your face with a buffet of snacks. You sweat profusely thinking about the invoice I will send.

Stop for a minute though. I have read the book "Mindset" by Professor Carol Dweck 5 times now. There are endless nuggets of truth in that book. Some of those truths hit lawyers between the eyes. My favorite quote is "It's not always the people who start out the smartest who end up being the smartest."

No matter the facts leading up to mediation, you MUST come in with a clean slate and open mind. Use the mediation process (and ahem....your mediator) to get what you want. I often say during mediation that I am the red flag in the center of the tug-of-war rope. Yank me back and forth. I love it!
