BROUSSARD LAW DEFEATS REAL ESTATE AGENT'S AND BROKERAGE'S MOTION TO DISMISS CLAIM FOR WITHHOLDING ADVERSE MATERIAL INFORMATION ABOUT PROPERTY FROM ITS CLIENTS TO GET THEIR COMMISSION

Based on our arguments, the Court held that Plaintiffs state a claim when they allege that their brokerage or agent knowingly withholds information from their client that might impact their decision to buy property.
This is an important in light of the fact that Georgia law states a real estate agent does not owe a fiduciary duty to their clients. Broussard Law developed a theory of the case to circumvent that statute when a buyer's agent conceals information that could lead to their client declining to purchase property or negotiating down the price (thereby depriving them of their commission).
