⚖️ Appeal vs. Modification: What's the Difference?

If you're unhappy with a family law court order, your first question shouldn't be, "Can I appeal?" It should be, "What are my legal options?"

While both appeals and modifications involve existing court orders, they serve very different purposes.

📄 An Appeal

An appeal asks a higher court to review whether the trial court made a legal error when issuing its decision.

An appeal is not a new trial. Generally, the appellate court reviews the record from the original case and considers whether the law was applied correctly. New evidence and new witnesses are generally not presented.

Appeals typically focus on questions such as:
• Did the trial court correctly apply the law?
• Were proper legal procedures followed?
• Did a legal error affect the outcome?

👨‍👩‍👧 A Modification

A modification asks the trial court to change an existing order because circumstances have materially changed since the original order was entered.

Examples may include:
