Always nice to get the call a couple of days before a scheduled motion to suppress that the State has decided it cannot prove a case.

This happened last week for a Client charged with possession of methamphetamine. The motion to suppress challenged a traffic stop where the Client was a passenger in a car with other people.

There were multiple issues with the stop. As part of our filing, I also shared with the State caselaw demonstrating that the facts, which only showed Client in constructive possession of the drugs, wouldn't be sufficient to convict. Requested a dismissal, and the State, after reviewing the case carefully, agreed to dismiss.

3rd Tier Drug Trafficking Case Dismissed!

Client was charged with a third tier trafficking in methamphetamine case involving more than 400 grams, which carries a mandatory minimum penalty of 25 years in prison.

After fighting the case for almost a year, ultimately secured a dismissal for the Client. Once the case was dismissed, got a records restriction and case sealed.

Records restriction is often called "expungement" and means the arrest cannot be seen on the criminal record when it is run for non-criminal justice reasons.

Case sealing ensures that the case can no longer be viewed in the Court's public records.

This is the absolute best result for any Client, and particularly sweet in a case like this where Client truly was in the wrong place at the wrong time.

Do you see that rainbow right there? That is for real. Saw it and stopped on the side of the road in Elbert County this afternoon to take the photo (had my hazards on, of course!).

THIS is what it's like being a defense attorney. That bright light that always comes at the end. No matter how dark things start for the Client. We get the rainbows after the rain.
