It's extremely hard to win a case against a county for an unsafe or dangerous road.

A merged local government, like Athens-Clarke County, is considered a consolidated local government that operates under county immunity. To hold a county responsible for an unsafe or dangerous road, you have to prove two things:

There was a violation of a ministerial duty
+
An employee had actual knowledge of the dangerous condition

Michael reacts to a tough case involving a collision between an e-bike in a crosswalk and a turning car.

The car has a responsibility to yield to pedestrians, especially in a crosswalk, but the e-biker did three key things wrong too:
1. Not wearing a helmet
2. Riding on the sidewalk instead of the road/ bike lane
3. Riding against the flow of traffic.

Did you know school buses in Georgia aren’t required to have insurance?

Because of sovereign immunity, suing the government after a school bus wreck isn't simple:

If your child is injured: You must sue the driver directly for violating a clear rule, like running a red light or speeding. Then the school district decides whether to defend them or pay.

If you're hit: You can file a claim against the school system if they carry insurance. If they don't, you can use your own Uninsured Motorist coverage.

While Georgia law requires riders to wear a helmet (and DadLaw highly recommends it too), not wearing one doesn't automatically bar your lawsuit against the other driver.

It comes down to the jury's decision. Would wearing a helmet have prevented the motorcyclist's severe injuries, or did the fault lie with the other driver for causing the wreck in the first place?

What happens if you get hit in a crosswalk, but the signal said, "do not cross"?

It depends. While pedestrians have a duty to follow the crosswalk signals, drivers also have a legal obligation to avoid hitting anyone in the middle of the street if they have the opportunity to brake.

Ultimately, it comes down to a jury to decide who's at fault.
