Just returned from attending the annual Texas Association of Family Defense Attorneys' (TAFDA) Annual Continuing Legal Education on the Beach in Galveston. I think this is our 4th year. We had a great time and covered some topics of interest. I was pleased to present the topic called "Can you take my kids for a Year?" In the event that your children are removed by CPS (in Texas, the Department of Family and Protective Services), parents have the right to request placement with family members or friends. This was not always the case. Sometimes CPS still will raise objections to family members and friends, but my topic was how to get the judge to place the children with your family and friends and overcome those objections.

Other topics of interest included defending shaken baby allegations and other medical abuse/neglect allegations, new case law and information on how to determine if children are being s*x trafficked.

Attorneys must continue their education after law school because the law is constantly changing.

Do you know what rights you have if CPS contacts you? You have rights, just like a person accused of a crime has rights.
1. You have the right to know what the allegations are being made against you. Don't be afraid to ask.
2. You have the right to hire an attorney to represent you in a CPS investigation.
3. You have the right to refuse to take a drug test, if you are asked to submit to a drug test.
4. You have the absolute right not to cooperate with the investigation, however, this may not be the best option.
If you don't know what to do, then it's best to contact an attorney who has experience helping people with CPS investigations.

In response to a recent message I received on Facebook Messenger, if you owe back child support, be advised that the last place the Texas Attorney General wants to see you is in jail. No one pays child support from jail unless someone else pays it for the person in jail or said inmate wins the lotto. The Attorney General in this County (Henderson) and some other Texas counties works with the Texas Workforce Commission in a program called, "Choices", to help the child support obligor to find a good job so he or she can pay their child support obligation. If you or someone you know owes child support, contact the Texas Attorney General for assistance. The Choices program is not available in all counties in Texas, but it should be.

Happy 33rd Anniversary to Danna Kirk Mayhall, Attorney at Law. It's hard to believe it's been 33 years since I took a leap of faith and put up a shingle to start my own business. No one wanted to hire me, so I hired myself and started my practice in a small room that First State Bank of Athens let me rent on the 3rd floor. It was one small room, which I divided with a room divider. Since that fateful day, May 17, 1993, I have been on my own. It's been scary at times, but I've persevered and now have a profitable practice. Thanks be to God for carrying us through the tough times, and thanks to my many clients who have trusted me with their cases. I couldn't have done it without either. I also couldn't have done it without my family, who have supported me every step of the way. From Danae, who was my first secretary, to Tara and Gordon, who are my primary support staff now: Tara for almost 20 years and Gordon for the last 6 years. Also, thanks to my grandchildren, Jordon, Bethany, David, Kyra, Ava, and Isaiah, who have all played a role as well, from time to time. There have been others as well who have worked for me and helped me more than they will ever know. I appreciate each of you. Cheryl Stanford, Connie Matthews Christopher, and Sandra Duke, just to name a few of my former employees, have become dear friends. And a big thank you to my husband, Terry. He used to serve papers for me, but he has always been there to give me a hand whenever I needed it, along with his advice.

I don't know how many years the Lord will allow me to work, but I am determined to keep on giving my best to my clients and serving the Lord at the same time.

Do you have a "FLE"? In my office "FLE" stands for Family Law Emergency. Examples of FLE's are: CPS is at my door wanting to talk to me. . . or the Police are here telling me I have to hand my child over to the other parent who is intoxicated or on drugs . . .
