SOLAR LITIGATION UPDATE
On February 11, 2025, Turner & Turner filed a laswuit on behalf of a local resident who had been visited by door-to-door salesmen who made fraudulent representations about the installation of residential solar panels. The lawsuit was filed in Clark County Circuit Court against the comapny which sold the panels, Nivo Solar, and against Solar Mosaic, which financed the transaction.
At the time of the sale, Nivo Solar was performing residential crontracing work without a proper state license. Turner & Turner alleged that these companies had violated the state's Deceptive Trade Practices Act and Home Solicitaiton Sales Act. Both companies responded to the lawsuit by filing motions to compel arbitration.
However, on June 6, 2025, Solar Mosaic filed for bankruptcy relief and Nivo Solar followed suit a few weeks later. As a result of these bankruptcy filings, a stay has been entered which prevents any customers from pursing civil claims against the companies.
In the months since this lawsuit was filed, many residents from around the state have contacted Turner & Turner about similar problems regarding Nivo Solar. Unfortuntaely, the recent bankruptcy filings prevent us from filing any new claims.
Persons who have potential claims against these companies should consider contacting a bankruptcy attorney for advice on participating in those bankruptcy proceedings. Turner & Turner would also encourage anyone who may have incurred losses as a result of deceptive practices or improper home solicitations by Nivo or any other solar provider to file a consumer complaint with the Arkansas Attorney General's Office.
