Did you know that certain assets can potentially be converted into
income as part of a Medicaid planning strategy?

For Pennsylvania families facing nursing home or long-term care costs, understanding the available options can make a significant difference.

One strategy is a Medicaid-Compliant Annuity (MCA). When properly
structured, an MCA can convert certain countable assets into a stream of income that may help an individual or spouse meet Medicaid's financial eligibility requirements.

This strategy can be particularly valuable for married couples when
one spouse requires nursing home care and the other remains at home.

However, Medicaid planning isn't one-size-fits-all. Eligibility rules
are complex, and not every strategy is appropriate for every family.
Before making major financial decisions, understand your options.

TozLaw helps families throughout Scranton and Northeastern
Pennsylvania navigate Medicaid planning and long-term care decisions.

What debts does an estate have to pay?

An executor may receive bills for credit cards, medical care, funeral expenses, taxes, loans, utilities, and other obligations. However, administering an estate is not as simple as paying every bill in the order it arrives.

The executor must determine which claims are valid, which obligations belong to the estate, and whether the estate has enough assets to cover them. When an estate cannot pay everything in full, Pennsylvania law establishes an order in which expenses and claims must be paid.

Paying the wrong debt, or distributing assets to beneficiaries too soon, could create complications for the estate and potentially for the executor.

TozLaw helps executors in Lackawanna County and throughout Northeastern Pennsylvania understand their responsibilities and properly administer an estate. Before paying substantial bills or distributing estate assets, contact our probate and estate administration attorneys for guidance.

Can an executor sell the deceased person’s house?

In many Pennsylvania estates, an executor may have the authority to sell real estate, but that does not mean the executor should
immediately put the house on the market.

Before proceeding, the executor may need to consider:

• What the will says about the property
• How ownership of the house is titled
• Whether the sale is necessary to pay estate obligations
• The interests of beneficiaries or other owners
• How the property should be valued and the sale documented

An executor has a responsibility to act in the estate’s best interests. Selling too quickly, accepting an inappropriate price, or overlooking another person’s ownership rights could create disputes or potential liability.

TozLaw helps executors in Lackawanna County and throughout Northeastern Pennsylvania understand their authority and properly handle real estate during probate and estate administration.

Before listing, transferring, or distributing estate property, contact TozLaw to discuss the appropriate next steps.

This post provides general information and is not legal advice. The executor’s authority depends on the will, the ownership of the
property, and the circumstances of the estate.

Sometimes being a good neighbor starts with a simple question: “How are you doing?”

This National Good Neighbor Day, take a few minutes to check in on an older neighbor, friend, or family member.

A conversation, a helping hand with something around the house, a ride to an appointment, or simply spending a few minutes together can mean more than we realize.

At TozLaw, we're proud to be part of the Northeastern Pennsylvania community and to serve the individuals and families who call it home.

Today is a good reminder to look out for one another and to be the kind of neighbor we'd all hope to have.
