If you have reached out about estate planning but have not moved forward yet, you are not alone. Here are a few common questions we often hear and their answers:

🔹 Why do you need financial details? They help ensure your plan reflects your actual situation
🔹 What affects cost? The scope of your plan and your goals both play a role
🔹 Why does the questionnaire matter? Complete information helps avoid delays and keeps everything accurate

The process is designed to create a plan that works for your life, not just a set of documents.

If you are still considering your next step, feel free to reach out. We are happy to walk you through it: https://www.rsmlawteam.com/

Estate planning can look very different depending on your situation. First marriages are often more straightforward. Second marriages can involve blended families, prior relationships, and different goals, including:

🔹 Children from previous relationships.
🔹 Shared and separate assets.
🔹 Different inheritance priorities.

These details can change how a plan should be structured.

A one-size-fits-all approach does not work here. Thoughtful planning helps avoid confusion and supports the people you care about. If your situation has changed over time, it may be worth taking another look at your plan.

If you have young children, estate planning is not just about assets. It is about making sure your kids are cared for by the right people.

A kids’ protection plan goes beyond naming a guardian on paper by:

🔹 Naming long-term guardians.
🔹 Identifying short-term caregivers.
🔹 Providing clear instructions for your children’s care.

Without a plan, decisions may be left to the court or handled in a way you did not intend. A clear plan helps make sure your children are cared for by people you trust.

Powers of attorney are often overlooked, but they matter. They allow someone you trust to make decisions on your behalf if you cannot. There are two types:

🔹 Healthcare power of attorney for medical decisions.
🔹 General power of attorney for financial matters.

Without these, your family may need to go through court to step in. Planning ahead creates clarity and makes difficult situations easier to manage.

Estate planning is not a fill-in-the-blank exercise. Your plan should reflect your actual life, not a generic template, taking into account:

🔹 Your family structure.
🔹 Your relationships.
🔹 Your assets.
🔹 Your long-term goals.

Online forms are simple, but they do not account for real situations. If your plan does not reflect your current life, it may be time to revisit it.

We often get asked: What is the difference between a will and a trust? A will outlines your wishes and is subject to probate. A trust can manage assets during your lifetime and may help avoid probate.

They serve different purposes, and many families benefit from using both together because:

🔹 A will handles distribution after death.
🔹 A trust can manage assets during life and after.
🔹 Both can work together as part of a complete plan.

Estate planning is not about choosing one document. It is about building a plan that fits your life.

What is your legacy?

Yesterday in church I learned about "wounded healers": people who gain a deep understanding from their own suffering and reach out to help others. None of us get through life without being wounded in some way, but it is what we do in response that is our legacy.

Do we respond to others with harshness because we are wounded?

Or do we respond with greater patience and compassion?

Out of all the things we could accomplish on earth, how about bringing more healing to humans?

Our time is so short. Tomorrow is not guaranteed for any of us. What can you do today to bring healing to others?

Think you’ll only deal with their stuff when it’s convenient? Think again.

Most people assume parents’ estate plans won’t affect them, but without a clear plan, you end up handling frozen accounts, stalled property sales, and family fights.

There’s a way to avoid getting stuck cleaning up a mess, and it starts with a simple conversation you probably haven’t had yet.

Watch this to see how to get ahead of your parents’ estate plan in North Carolina.

Most people think the law can handle family matters. It can’t. Folks assume the default rules treat everyone fairly. They don’t. Following the formula can drain time, money, and patience while relationships fray.
