I just received an email from the "Arizona Ministry of Communications" claiming that I have an outstanding unpaid traffic ticket (I have none). Failure to click a link and pay by June 13th (2 days after the message was sent) will cause license suspension, a 35% "fee", and more!

This is yet one more scam to be aware of. Arizona state government has departments but not ministries. Moreover they do not communicate important notices via email. The state Attorney General has posted this warning:

Following the death last year of Hiroko Perry, my wife and partner, I ceased taking on new clients and I have recently closed my office for good. After more than 2 decades overseas working for investment banks, the 15 years representing working families and individuals in Arizona has been a real eye opener. I had intended to continue the office for another six or seven years, however without Hiroko's help that proved not to be feasible. Maricopa Title Alert

"Maricopa Title Alert is a free program which monitors and alerts subscribers when documents are recorded with the Maricopa County Recorder’s Office under an individual and/or business' name. The program, which launched in June 2023, can help to monitor you and your business' name. More than 70,000 Maricopa County residents currently have an account."

Everyone who owns real estate in Maricopa County Arizona should take advantage of this free service which will alert you whenever a document (such as a deed) is recorded which includes the name of any person whom you want to protect from "deed theft". Here is how the Recorder's Office describes the service:

"This service applies only to documents recorded after sign up. There is no limit to how many names a subscriber can monitor under their account. Users may unsubscribe or make updates to this service at any time, but subscribers must maintain a current email and/or phone number to ensure accurate notification."

I received an email notice today informing me that 2 documents had recently been recorded by a person named "John Perry" (fortunately the middle name was different from mine and the property description did not match mine). If someone did try to forge my signature on a deed purporting to sell my home I would have received an email which would allow me to take immediate action before the problem became much worse.

I just learned about a fraudulent scheme to steal someone's home (in this case Elvis Presley's Graceland!). Although this one isn't going to be successful, as though a scam to foreclosure on Graceland wouldn't attract plenty of attention, I imagine the identical scheme for a less famous property might very well be successful.

CNN did a good job running to ground the facts, however what is missing mention of any activity by the local district attorney's office--this must be a crime that can be prosecuted!

Elvis Presley’s granddaughter is suing to stop a foreclosure sale of the late singer’s historic Memphis home, Graceland, scheduled this week, alleging fraud and saying the purported company behind the sale doesn’t exist and has no rights to the property.

My clients who are on Medicaid, and others who have family members in the program need to know that the federal government is requiring all states to review their entire list of "enrollees" to determine whether they are eligible to continue receiving benefits. This happened as the result of the national health emergency (COVID) which officially ended on April 1st. When AHCCCS (the Arizona Medicaid agency) contacts you (and they have 14 months to do so) you need to respond to their request for information. Failure to do so will likely result in a denial of benefits and will require the enrollee to start a new application and the family will need to pay for care which AHCCCS has been taking care of. And another thing, once AHCCCS stops paying the enrollee may face eviction proceedings brought by the care facility!

As pandemic protections expire, states are redetermining which people are eligible for the health insurance program.

Elizabeth Warren asks bank regulators (in the video below) a very pertinent question (to which she already knows the answer): when was the last time you took a Wall Street bank to trial? While I was an in-house attorney with banks the knowledge that there would never be litigation for even the most egregious violations of law made it rather difficult to get bank staff to take compliance seriously.

Someone drank too much coffee this morning before a Senate Banking Committee hearing and decided to "do the job we hired her for" and ask the question the rest of us have been "asking for years." That someone is my new favorite senator, Elizabeth Warren. Someone go on another Starbucks run for her,....

In the past 2 years more and more clients of mine have been using Zelle to pay legal fees. I just learned from a NY Times article ("Fraud is flourishing on Zelle. The Banks Say It's Not Their Problem"; March 6, 2022) that Zelle users are being targeted by scammers and unlike fraudulent credit card transactions customer losses are refunded, banks are treating fraudulent Zelle transactions as the customer's fault.

The suggestion to avoid being scammed is as follows: if you are contacted by someone claiming to be a bank representative (this could be a text or a phone call) who asks you to make a Zelle transfer (to supposedly avoid being scammed), ask for the person's name, hang up, and call the bank and inquire directly. https://www.nytimes.com/2022/03/06/business/payments-fraud-zelle-banks.html?

Zelle, the payments platform used by millions of customers, is a popular target of scammers. But banks have been reluctant to make fraud victims whole — despite owning the system.

This is the single most important article I have ever read in the New York Times. To my friends who support Trump, and also to those who believe that a Democratic president will fix America's problems, please believe me this is not "fake news". Politicians from both parties are responsible for creating the problems described in this article, which I hope my friends will read and consider, over many years (dating back at least to the Vietnam War) and the solutions are drastic measures that no current politician worrying about his or her reelection is unlikely to ever propose (that's a subject for another essay which requires delving into a subject that Americans despise--economics). I spent many years working in big cities (Tokyo, New York and Singapore) where I was sheltered from what was happening to working class families, but I have now for the past decade plus had a steady dose of reality as I work exclusively with middle and working class families. Trump became president because of the desperation felt by these families despite the fact that he is not one of them and actually could care less about their plight. His policies do not address this dilemma, BUT NEITHER DO THOSE OF HIS DEMOCRATIC CHALLENGERS. Printing money to prop up the stock market or providing free health care (as important as that is) or wiping out student loan debt, etc., are not even the beginnings of a solution. I'll get off the soap box now and get back to work.

Across America, working-class people — including many of our friends — are dying of despair. And we’re still blaming the wrong people.

This past month my time has largely been spent on 2 cases involving exploitation of elders, (one involved theft by a family member and the second by a caregiver). Adult Protective Services is simply overwhelmed by the volume of cases. Families need to be aware of this problem and monitor caregivers and others, including family members holding a power of attorney, and take action when an abuse is discovered. This recent article highlights the extent of the problem which will continue to grow until the Baby Boomer generation has departed the planet:

In just the past few years, seniors lost an average of $41,800 due to elder financial abuse, according to the Consumer Financial Protection Bureau. However, there are ways to prevent it from happening.

I am frequently engaged by clients to appeal decisions by the Arizona Dept. of Developmental Disabilities (DDD) reducing or terminating benefits for disabled family members, but today I am posting an illuminating article about the hardships faced by the DDD staff themselves: DDD is unfairly penalizing older more senior employees at the expense of new hires, and then illegally threatening them for daring to complain, or even inquire, about the discrepancy in pay! Bravo to the Phoenix New Times and Arc of Arizona for bringing this to my attention:

"I told my case worker team about the email, but I didn't enforce it, because it's not ethical."

The surprising results of 2 government studies of nursing home abuse is something my clients, and others with elder family members, should be aware of: failure to report is rampant even where the abuse results in a visit to the emergency room! Although the failure to report is itself a crime, what the studies tell us is that it is incumbent on family members to keep a close eye on the nursing home and report to law enforcement at the first sign of abuse--no one else is likely to do so:

Workers in nursing homes, hospital ERs and other health facilities are required by law to notify police whenever they notice likely signs of physical or sexual abuse. But that's often not happening.
