There has been a major shift in Maryland law and the right of persons to possess fi****ms.

Unlike in the past rulings regarding police interactions and searches, when the presence of a fi***rm was presumptively illegal-now the Supreme Court of Maryland has held that the mere observation of a fi***rm is insufficient to justify a Terry stop in Maryland.

Officers must demonstrate specific, articulable facts indicating that illegal possession or criminal activity is afoot, beyond the mere presence of a fi***rm.

The holding of Steven Hicks v. State of Maryland, No. 634, Appellate Court of Maryland (September Term, 2024, Opinion by Graeff, J.)

The holding is based upon the U.S. Supreme Court decision in New York State R***e & Pistol Ass’n., Inc. v. Bruen, 597 U.S. 1 (2022).

Bruen ruled that the Second and Fourteenth Amendments protect a law-abiding citizen’s right to carry a fi***rm outside of the home for self-defense.
