A lot of business owners think:
"I'll deal with the trademark once my business gets bigger."

But by then, you may have already invested in:

- Your website
- Packaging
- Social media
- Advertising
- Customer recognition
- A whole identity around the name

And if you later discover a trademark issue with that name, changing course can be much more complicated.

Building the brand and thinking about protecting the brand don't have to be separate conversations.

If your business is growing, it's worth asking:
“Is the name I'm building on something I should be protecting?”

That question is worth answering before you put even more behind the brand.

DON’T END THE WEEK WITHOUT CHECKING THIS.

Before you close the laptop for the week, here’s one thing worth putting on your checklist:

Check the name you’re building your business around.

Not just on Google.
Not just on Instagram.
Not just to see if the domain is available.

If you're planning to invest more into your brand, you want to know whether there are existing trademark rights that could potentially create a problem for the name you're using.

Because changing a name after you've built the website, packaging, social presence, marketing materials, and customer recognition around it can be a very different project than choosing the right name from the start.

So before next week gets busy again:
Ask yourself: Have I actually checked my brand name from a trademark perspective?

If the answer is “not really,” that's worth putting on your list.

💬 Comment CHECK, and we'll message you the link to schedule a consultation.

DON’T JUST GOOGLE YOUR BRAND NAME.
DO THIS INSTEAD.

You searched your business name on Google.

Nothing obvious came up. So you figured, “Looks available!”

Not so fast. 👀

A basic Google search can show you websites, social media pages, directories, and businesses using the same or similar wording, but trademark conflicts can involve similar names, related goods or services, and marks that aren't immediately obvious from a regular search.

That’s why a trademark search should go beyond simply asking:
“Does anyone have this exact name?”

A better question is:
“Could an existing trademark create a problem for the brand I want to build?”

That difference matters before you invest more time and money into a name.

You find a name you love.

It sounds good.
It looks good on a logo.
The domain is available.
You can already picture the packaging.

And then comes the part people sometimes skip:

Is this actually a name you can build around?

Before investing heavily in a brand name, it's worth considering things like:

• whether similar trademarks already exist
• what goods or services you'll offer under the name
• whether the name is distinctive enough to function as a trademark
• where you eventually want the business to go

Because changing a name after you've built the website, packaging, social media, and customer recognition around it can be a very different conversation.

Love the name. Then investigate the name.

Friday reminder: Don't let a quick Google search be your entire trademark strategy.

You search the name.

Nothing obvious comes up.

So you move on.

Totally understandable, but a Google search isn't the same thing as a trademark clearance search.

Trademark conflicts aren't limited to businesses using the exact same name. Similarity, the related goods or services, and other factors can matter when evaluating potential conflicts.

If you're getting ready to build a business around a name, it's worth looking into before you spend heavily on the website, packaging, signs, marketing, and everything else that comes after.

💬 Comment SEARCH, and we'll message you the link to schedule a consultation.

Have a great weekend, and good luck building something worth protecting. ❤️

PEOPLE DON'T KNOW THIS ABOUT TRADEMARKS…

You can have a registered trademark and still have limits on what you can claim.

A federal trademark registration is valuable, but it doesn't mean you own a word or phrase for every possible use.

Trademark rights are tied to the particular mark and the goods and/or services covered by the registration.

For example, a business may have rights in a mark for one category of goods or services without automatically having exclusive rights to that same wording across completely unrelated industries.

That's one reason trademark protection isn't simply:
“I registered the name, so nobody can use it.”

The details matter.

If you're considering registering a brand and want to understand what protection may actually be available for your goods or services:

EXPERTS DON'T TELL YOU THIS ENOUGH…

Your trademark strategy should know what your business actually sells.

Here's something that gets overlooked:

Trademark protection isn't considered in a vacuum.

Your application identifies particular goods and/or services.

Those descriptions matter.

If your business sells software, clothing, consulting services, food products, and online education, for example, those aren't interchangeable categories.

The goal isn't simply to collect as many classes as possible.

It's to accurately identify the goods and services connected to the mark.

BEFORE YOU PAY A FILING FEE…

Know what you're actually paying for.

A trademark filing isn't simply a matter of paying the government filing fee.

Depending on the situation, there can be decisions around:

• the filing approach
• goods and services
• application preparation
• legal review
• potential issues during examination

That's why it's worth understanding what's included in the service you're considering, not just the number at the bottom of the page.

We've put together our current trademark application options and rates so you can compare them.

MOST BUSINESS OWNERS DON'T REALIZE THIS…

Your trademark can be more than just your business name.

When people hear "trademark," they usually think of the name of their company.

But trademarks can also be used for things like:

• product names
• service names
• logos
• slogans
• other identifiers that distinguish your goods or services

So if your company has a signature product or service that customers recognize by name, don't automatically assume the company name is the only thing worth discussing.

The first question should be: What are you actually trying to protect?

If you're considering protecting a name, logo, or product brand, comment PROTECT and we'll message you the link to schedule a consultation.

This one is harder than it looks. 👀

From a marketing perspective, an immediately understandable name can be attractive.

From a trademark perspective, distinctiveness matters.

A highly distinctive mark can generally be stronger than wording that merely tells customers what the product or service is.

So we're putting the question to the entrepreneurs:

Which would you choose? A or B?
