It is a good time to think about having your planning in place. We are doing remote signings and curb side signings too. **** Today the Indiana Supreme Court issued special orders to confirm and encourage the use of remote notarizations of documents like power of attorneys and deeds and remote signings of estate planning documents like wills and healthcare advance directives. *****
The use of a trust fully funded (this is essential) eliminates the need for two witnesses like a will requires, plus avoids the delay of court hearing, when hearings are only by phone.

With COVID-19 impacting more and more Americans, individuals across the country are scrambling to set up wills and end-of-life directives.

As a result of Coronavirus (COVID-19) concerns and the March 19th County-wide order affecting all non-essential businesses, our law office will remain open; however, now through April 6, 2020, we are not opening our law office doors for in-person visitors, but want to advise you of the following:

• use of phone and video conference will allow us to continue to complete your work we are committed to do - just call or email us

• we can receive and send documents by snapping a photo with a cell phone & text (765-620-0602) or email it; by fax, email, or there is a drop off slot in the 10th Street side door.

• we upgraded our phones and internet last week to increase our capabilities

• remote signings and notarizations are being utilized for document signings as Indiana laws allow (see our October 2019 Facebook post about these new laws)

• we have remote secure access to files and call & mail forwarding, and our staff tested last week capabilities of working remotely so if the governmental guidance requires it in the future, we are ready

• we have credit card processing to handle payments of invoices for legal services

• thankfully we have avoided any infections, but In a continuing effort to protect our staff and clients, we will continue to disinfect our surfaces, use frequent hand-washing & hand sanitizer, and social distancing.

• Please keep in mind, our staff may be working non-traditional hours and many are facing stressful situations like you. If you have an urgent need, please contact us by telephone at (765) 643-9787, or if on Fridays, weekends, or lunchtime, call the number on the answering machine, 765-620-0602.

Indiana entered this in new frontier last year; however, Indiana does NOT allow an Indiana resident to use an electronic unless there is the actual presence of all witnesses and the person (testator) in the same room --- no remote or video presence of witnesses is allowed. It is believed this requirement will reduce the risk of fraud and abuse of the testator.

Recently, the ULC approved the Uniform Electronic Wills Act. The world relies on the ability to transmit information electronically – we have become irreversibly dependent upon it. The Act builds a bridge between traditional will ex*****on and technological advancements affecting the field.

Go to Guardian Advocates Inc FB page and follow it & like it. My wife Amber & I formed a non profit corporation to provide guardianship services to at risk adults without family to help them. It is a volunteer model like CASA, except for adults. We run the VASIA program for our County with a seed grant from the state courts and coordinated by the local courts.
