When can you get a motion for temporary relief?

If a client needs issues resolved quickly and can't wait for the whole divorce process to play out before addressing who will have custody of their kids, a motion of temporary relief is filed.

The motion asks the court to decide on a temporary basis for certain issues in the case.

At the end of that motion for temporary relief hearing, the court will issue a temporary order, which is in place until either case is resolved or there's another temporary order issued.

This allows the court, for the time being, to decide issues that more urgently need to be decided and can't wait until a divorce is finalized.

In S.C. close to everything you obtain after you’re married is considered a marital asset up to the date of filing for separate support and maintenance or divorce.

So, it doesn’t matter if it’s in the husband or wife’s name. It is considered a marital asset regardless.

However, if one spouse receives an inheritance from a grandparent and they keep the money separate in a separate account, that can be an exception.

Another exception is any property that was only in one spouse’s name prior to the marriage and they never changed the title.
