Today was a great academic day for Ludwig Law Center, Inc. We were referred a case from another Family Law attorney to represent the parents of his client on a Complaint for Joinder. The allegations were that husband acquired an interest in the parents’ house the parties rented from them because he did repairs to their residence and that somehow gave him an interest in the property, or at a minimum, husband was entitled to reimbursement.

We filed a Demurrer to the complaint for Joinder (which you rarely see in family law cases). In fact, opposing counsel threatened us with sanctions multiple times for daring to file such a “frivolous and impermissible motion” in the family law case. The narrow exception is on joinder actions where the underlying issues are civil in nature. We also filed a motion to dismiss for lack of subject matter jurisdiction because the family court is not the proper court to hear the issues presented.

The Judge read everything and had the Superior Court research attorneys check our legal position and supporting law. After months of legal briefs, the Judge agreed that the demurrer was properly pled and dismissed the Complaint for Joinder for lack of subject matter jurisdiction. Needless to say, we have some extremely happy clients. Great academic win for LLC.

Eric and I went to dinner tonight near our home. There was a woman there with her two sons (about 11 and 12 years old) who sat down near our table. She sat there and loudly badmouthed the kids’ father to these kids over and over. We were stunned. We know it happens, obviously since we’re divorce attorneys, but seeing or hearing it firsthand was disgusting. Even if true, do not do this to your kids! You are destroying your children! Stop!

PSA: I am happy to announce the Courts are starting the process of re-opening. We are conducting status conferences by telephone and through virtual platforms. The Courts are hearing domestic violence matters and scheduling divorce/custody hearings. With the current state of affairs in CA, most hearings and meetings are being conducted through WebX or Microsoft Teams. The Supervising Judge of the Orange County Superior Court-Family Law has issued Administrative Order No. 003, regarding COVID-19.

“COVID-19 is not a reason to deny parenting time. Unless otherwise ordered by the court, parents are considered fit to care for their children and make decisions regarding the day-to-day aspects of parenting while the children are in their care. This day-to-day care includes following all Health Authority and County Public Health directives regarding social distancing and sanitation-related measures (such as frequent handwashing).”

Please ensure full compliance with this Order to avoid significant sanctions.

COVID-19 update as it relates to child custody orders:

Today, Eric appeared in Court in downtown LA to oppose an Ex Parte (emergency) request for custody filed by the mother to stop all visits by our client until the Governor lifts the stay-in-place order. Both parties were represented by attorneys.

Mother argued that the “shelter in place order” should be a reason to not allow the other parent their visitation. We opposed this argument (great brief written by my wife) stating that these orders were never intended to deprive a parent of their custodial rights. We prevailed.

The request was denied and our client has his custodial time. The point here is that current custody orders remain in full force and effect unless modified by a Judge. The threat of COVID19 is not a basis to deny visitation.

CAVEAT: This is not to say that in certain circumstances where a parent is acting negligently or a parent actually has the virus, the Court won’t stop the visits. This is all new and evolving. Stay tuned......
