éclat Law LLP We love the practice of law. It allows us to do what we do best: solve problems. Then big law got too big. Not here. And we are committed to doing it brilliantly.

We excelled at law school and thrived in big law firms like K&L Gates and Shearman & Sterling. We fought for and against big corporations, closed multi-billion dollar deals, merged software companies and settled complex litigation cases long before they were allowed to drain resources. Common sense became buried in stacks of motions, logic lost in endless redlines and rational thought tested and t

eased by lawyers focused not on their clients, but on outwitting each other. We eschew intricacies when facts beg for simplicity. Our job is to solve your problems, or better yet, prevent them.

Happy National Boss's Day! Today, we tip our hats to the workplace warriors - our bosses! They juggle a million tasks to keep everything running like a well-oiled machine. From doling out advice to making the tough calls, they deserve all the kudos!

National Boss's Day kicked off in 1958 when Patricia Bays Haroski, an employee at State Farm, decided her father (who was also her boss!) deserved a special day, so she made October 16th the chosen one!

Take a moment today to shower your boss with appreciation! A sweet note or a cup of their favorite brew can go a long way. It’s the little gestures that make hearts swell!

So, to all the fabulous bosses out there, thank you for being our guiding stars and making work a better place. Happy National Boss's Day! Cheers, Kevin and Katina Ross.

Juneteenth, also known as Freedom Day or Emancipation Day, is a holiday that is celebrated annually on June 19th. This day commemorates the end of slavery in the United States and the announcement of the abolition of slavery in the state of Texas in 1865.

The history of Juneteenth dates back to the Civil War when President Abraham Lincoln issued the Emancipation Proclamation on January 1, 1863, which declared that all enslaved people in the Confederate states were to be set free. However, it was not until two and a half years later, on June 19, 1865, that General Gordon Granger arrived in Galveston, Texas, and announced that all enslaved people were free, marking the official end of slavery in the United States.

On this day, many cultural events, parades, and festivals are held to celebrate the rich heritage and culture of African Americans. Traditional foods such as barbecue, red soda, and watermelon are also a part of the celebrations.

Juneteenth is a significant holiday that celebrates the end of slavery in the United States and the triumph of freedom over oppression. It is a day to honor the struggles and sacrifices of African Americans and to celebrate their rich heritage and culture. Let us continue to educate ourselves and work towards creating a more equitable and just society for all.

If you believe that your employer has violated the provisions of the Fair Labor Standards Act (FLSA), you have the right to file a wage claim. A wage claim is a legal document submitted to the Department of Labor or a state labor agency that outlines the wage dispute between you and your employer.

The FLSA guarantees that workers are paid a minimum wage and overtime pay for hours worked over 40 in a week. Your employer is also required to keep accurate records of your hours worked and wages earned. If your employer has failed to comply with these regulations and you have been denied proper compensation, you may be entitled to file a wage claim.

If your employer is found to have violated the FLSA, you may be entitled to back pay, interest, and liquidated damages. In addition, the FLSA provides protection against retaliation by your employer for filing a wage claim. Employers are prohibited from taking any adverse action against you for exercising your right to file a wage claim.

Overall, wage claims serve as an important tool for employees to protect their rights and ensure that they are fairly compensated for their work. If you believe that your employer has violated the FLSA, do not hesitate to take action and file a wage claim.

Civil rights discrimination cases refer to instances where individuals are subjected to unfair treatment or denied equal opportunities based on their race, color, religion, s*x, age, disability, or national origin. These cases can occur in various settings, including employment, education, housing, and public accommodations. Discrimination can take various forms, such as subtle biases, microaggressions, or overt acts of harassment and exclusion.

To combat these discriminatory practices, several laws were implemented to protect individuals from unfair treatment. The Civil Rights Act of 1964, for instance, prohibits discrimination based on protected classes such as race, color, religion, s*x, and national origin in employment settings. The Americans with Disabilities Act (ADA) also prohibits discrimination against individuals with disabilities in various areas, including employment, public accommodations, and transportation.

The Age Discrimination in Employment Act (ADEA) protects individuals aged 40 years or older from discriminatory practices in the workplace. The Fair Housing Act (FHA) also protects individuals from discrimination based on race, color, religion, s*x, national origin, familial status, or disability in housing transactions.

Despite the existence of these laws, discrimination cases remain prevalent. Discrimination can have a profound impact on individuals and society as a whole by perpetuating systemic inequalities and depriving individuals of opportunities to thrive. It is essential to recognize and address these discriminatory practices to foster an inclusive and equitable society that values diversity and respects human rights.

Salaried worker violations are unfortunately all too common in the employment world. The issue arises when exempt employees, who are not subject to overtime pay and minimum wage laws, are not paid the wages they are owed. This violation is a breach of the Fair Labor Standards Act (FLSA), which requires employers to pay their employees fair compensation for their work.

Under Florida law, exempt workers must be paid a salary of at least $684 per week, mainly those in administrative or executive positions. This amount ensures that these employees are being fairly compensated for their work and are not being taken advantage of by their employers.

However, if you are an exempt employee making less than the minimum salary requirement, or a salaried non-exempt employee being forced to work overtime without proper compensation, then you have legal rights. You can contact the employment litigation lawyers who will take action to ensure that you are paid fairly for your work.

It is essential to know your rights as an employee and to stand up for yourself when you are not receiving fair compensation. The FLSA provides protection for employees against wage theft and other employment violations, and it is the role of an experienced employment lawyer to ensure that these rights are upheld.

Individualized Education Plans (IEPs) are crucial in ensuring that students with disabilities receive the education they need to succeed. These legal documents are carefully crafted by a team of educators, school administrators, and parents, with the goal of meeting each child's unique needs. The eligibility for an IEP is determined by the severity of the student's disability and the need for special education services, making it a critical tool for students with disabilities.

The IEP serves as a roadmap for the student's educational journey, outlining their current performance levels, strengths, needs, and annual goals. It details the specialized services the student is entitled to receive and includes measurable annual goals in each area of need. This allows for clear tracking of the student's progress and provides valuable insights for educators and parents.

The IEP spells out the impact of the disability on the student's learning and participation in school. This level of detail facilitates the development of targeted strategies and resources to support the student's learning process, enhancing the effectiveness of the IEP.

IEPs are a vital tool in ensuring that students with disabilities receive the education they need to succeed. The document provides clear guidance for educators and parents, allowing them to develop targeted strategies to support the student's learning process. It is imperative that all stakeholders remain proactive in revising and updating the IEP to meet the student's evolving needs, ensuring that they have the best chance for success both in and beyond the classroom.

Retaliation in the employment field is a serious issue that can have severe consequences for employees who engage in legally protected behavior. Despite laws that prohibit retaliation, many employers still engage in retaliatory actions against their employees, which can lead to a toxic work environment and even termination.

Retaliation can take many forms, including harassment, demotion, termination, and reduced pay or benefits. It can also include micro-managing an employee's work and giving them negative performance reviews, even if their work is of high quality.

Employees who engage in legally protected behavior, such as making a worker's compensation claim or joining a union, are particularly vulnerable to retaliation. If an employer takes any adverse action against an employee as a direct result of their engagement in these protected behaviors, the employee may be able to bring a retaliation case against them.

Retaliation can have a chilling effect on employees' willingness to speak up about workplace issues, which can ultimately harm the employer as well. Employers should take all necessary steps to prevent retaliation and create a safe and supportive work environment for their employees.

If you have experienced retaliation in your workplace, it is important to speak with an experienced employment law attorney who can help you understand your rights and take action to protect them. By standing up to retaliation, you can protect yourself and other employees, and help create a workplace culture that values fairness and respect.
